Sunfish Lake Drive. A portion of Sunfish Lake Drive, an MSA standard street, will <br />be constructed through a portion of the Wood Pond Hill subdivision. The developer has <br />agreed to be assessed for the equivalent residential section of this roadway and to have thc <br />cost dislributed proportionately among thc 135 total lots identified in thc prcliminar), plat of <br />the Wood Pond Hills subdivision. The developer, therefore, agrees to be assessed for <br />16/135 of the equivalent residential section of Sunfish Lake Drive N.W. constructed within <br /> <br />the Wood Pond Hills subdivision. <br /> <br />]mt~rovements to be Constructed by Develor~er. The DEVELOPER shall be <br />responsible, at its expense, for lot and street grading in accordance with those plans <br />consisting of four (4) sheets, drawn by McCombs Frank Roos Associates, inc. and dated <br />August 16, 1991, except that Sheet I of ,~ has a revision date of December 12, 1991 and <br />Sheet t~ of z~ has a revision date of December 3, 1991. The rough grading, as described <br />herein, shall be completed prior to the CITY undertaking construction of any of the Stage I <br />Improvements described above. <br /> <br />7. Reserved. <br /> <br />Boulevard an~l Area Restoration, The DEVELOPER shall be responsible for the <br />cost of establishing seed or sod in all boulevards within thirty (30) days of the completion <br />of the street improvements, and restore all other areas disturbed by the development <br />grading operation in accordance with the approved erosion and sediment control plan. The <br />DEVELOPER shall also be responsible for the cost of cleaning any soil, earth or debris <br />from the wetlands within and adjacent to this Plat resulting from grading performed in the <br />development of the land. <br /> <br />Finaneine. In the event that the CITY, for whatever reason, is unable to sell the bonds <br />as anticipated herein, the construction of the improvements shall immediately cease until the <br />CITY approves an alternate method by which to insure payment to the contractor for <br />construction of the Stage I Improvements. <br /> <br />10. Develooer_Reimbursement of All City Expenses.
