I I I Background: Drum's on the Rum, Inc., has applied for a transfer ownership of the liquor license at McDuf£s Eatery and, Pub fr~m RRM Enterprises, Inc. This license is an On-Sale Intoxicating and Sunday Sales licens¢~ T~e applicant proposes to keep the trade name as McDuffs and the premises remains 16({59 St.iFrancis Boulevard N.W. I have receive~ from the applicant documentation required by City ordinance that shows the taxes have been paid thy~ugh the first half of 1992 and they have submitted a financial statement that has been revie~ve,,tl b~ the City Attorney and found to be adequate. The remodeling plans for the premises show an, expansion of the dining area and no apparent change in the bar area. The applicant hasipaid the $250.00 investigation fee and I have determined that the officers of the corporation have nO liquor related criminal convictions. The required liquor liability insurance is to be in effect:al thefdate of Council consideration of the license, per the carrier, and I will have documentafiOri to ~at effect on that date. The license fee has been paid for the 1992-1993 period by RRM Enterprises, Inc., the former owners of lth6 business. When Jimmy B's American Cafe and Lounge was sold and became Lally's on lOthe.~ity agreed, since the license fee had been paid for the license year already, that Jimmy B's and La~ly's could work out their own deal on payment to each other. As far as the City was coneemefl th~ fee was paid. I told Mr. Dom of RRM and Mr. Drum of Drum's on the Rum that I woUld!P~eseflt this same scenario to the Council for consideration on July 28, 1992. ff this is not acceptable to (?.ouncil, then Drum's would pay a $4,200.00 fee, or a pro-rated fee very close to that, and ,the' ~ty ~ould refund to RRM the balance of the fee they paid June 30, 1992. Recommendation: I see no Problems With issuing an On-Sale Intoxicating Liquor and Sunday Sales license to Drum's on the Rum, Ific. a,,nd recommend that this be done. Council Action: Motion to app~ve[disapprove granting an On-Sale Intoxicating Liquor and Sunday Sales license to Drum's on the Rum, Inc. 1 Motion to d~r¢ct [§at Mr. Dom of RRM Enterprises, Inc. and Mr. Drum of Drum's on the Rum, Inc. work out'paYment to each other with regard to the license fee. 1 I - or - Motion to direct that Mr. Drum of Drum's on the Rum, Inc. will pay a pro-rated liquor license fee and that the City rgfund to RRM Enterprises, Inc. the balance of the fee they paid June 30, 1992.
