That on Dacember 17, 1985, a conditional use permit was issued to the subject property <br /> under l~he dame of Gerald Root for auto sales and repair. Said conditional use permit was <br /> revoke~:l on!January 28, 1992, for non-compliance. <br /> <br />11. That the prbposed use will not adversely impact traffic in the area. <br /> <br />12. That tile prPposed use will not be dangerous or detrimental to persons residing or working <br /> in thc ~,icitfity of the proposed use. <br /> <br />13. That~the Pr~Oposed use will substantially or adversely impair the use, enjoyment or market <br /> value ~f su~ounding properties. <br /> <br />l zl. That ihe pi'oposed use will not be harmonious with and in accordance with the specific <br /> objectives bf the Comprehensive Plan. <br /> <br />15. That the p~oposed use will not be operated and maintained in order to be harmonious and <br /> apP~griat~ in appearance with the existing and intended character of the R-3 Urban <br /> Resid,~ntia] District and the proposed use will change the essential character of the R-3 <br /> urban?Residential District. <br /> <br />16. That the pioposed use will be disturbing to existing or future neighboring land uses. <br /> <br />17. That thc pioposed use will not be an improvement to the property in the immediate vicinity <br /> and i~:th¢ ~ommunity as a whole. <br /> <br />18. That the P~oposed use will be adequately served by essential public services and facilities. <br /> <br />t9. That thc p.l'oposed use will not create excessive additional requirements at public cost for <br /> pubii~ facilities and services and that the proposed use will be detrimental to persons, <br /> prop~t-ty o~' the general welfare. <br /> <br />20. That at, th~ public hearing, the Applicant amended his request to a temporary conditional use <br /> permit notlto exceed 18 months. <br /> <br /> : <br />21. That at th~ public hearing, the Applicant indicated that if a temporary conditional use use <br /> permit is granted, he would not construct improvements to the property and accordingly <br /> would withdraw the site plan dated March 16, 1992. <br /> <br />22. That ~he :Applicant has indicated that the decision to amend the request to a temporary <br /> conditional use permit is in response to City Staff concerns with the compatibility of an <br /> auto ~pai~ facility in a residentially zoned area. <br /> <br />23. That/he Applicant has indicated that he has entered into a purchase a~eement for the <br /> subject prbperty, which is hereby incorporated as a part of these findings by reference. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer and upon vbte being taken thereon, the following voted in favor thereof: <br /> <br /> <br />
