EXHIBIT A <br /> CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> <br />ASSESSMENT,AGREEMENT - CHESTNUT HILLS 2ND ADDITION <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal corporation of the Stateof Minnesota (the "City"), and GOOD VALUE HOMES, INC., <br />a Minnesota corporation, whose address is I460 93rd Lane N.E., Blaine, Minnesota 55434 (the <br />"Developer"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of the following described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described as <br />follows upon recording of the plat: <br /> <br />Lots 1 through 6, Block 1; Lots 1 through 6, Block 2; Lots 1 through 6, Block 3; <br />Outlot A; Chestnut Hills 2nd Addition, Anoka County, State of Minnesota. <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on June 23, 1992, pursuant to Resolution No. 92-06- , the City has <br />approved the final plat of a portion of the Subject Property which plat is known as Chestnut Hills <br />2nd Addition (the "Plat") which approval is contingent on certain requirements, including <br />Developer and City entering into a Development Agreement (the "Agreement"); and <br /> <br /> WHEREAS, the Agreement requires that the Developer enter into this Assessment <br />Agreement relating to certain Public Improvements which the City installed for the benefit of the <br />Plat. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants and obligations of the <br />City and the Developer, each party does hereby represent, covenant and agree with the other as <br />follows: <br /> <br />ARTICLE I <br /> <br />REPRESENTATIONS AND UNDERTAKINGS <br /> <br />1. The Developer makes the following representations and undertakings: <br /> <br />The Developer has the legal authority and power to enter into this Assessment <br />Agreement. <br /> <br />bo <br /> <br />The Developer will comply with and fulfill each of its obligations as required by the <br />Agreement. <br /> <br />2. The City makes the following representations and undertakings: <br /> <br />a. The City is authorized by law to enter into this Assessment Agreement. <br /> <br />bo <br /> <br />The City will comply with and fulfill each of its obligations as required by the <br />Agreement. <br /> <br /> <br />
