,~eci~ I Provisions: THE CITY and THE ENGINEER mutually agree that this <br />A~ree nent shall be subject to the following special provisions which shall supersede <br />°t~her Conflicting provisions of this Agreement. <br /> <br />A.i All change orders shall be approved by THE CITY before they are issued to <br /> '.t e Contractor. <br /> <br />B,~ iTHE ENGINEER shal~ furnish construction staking and construction grade <br /> ;sheets in a timely manner in accordance with construction contract. <br /> <br />F; <br /> <br />r. THE ENGINEER shall furnish full-time resident inspection of the Project as <br />Idirected by THE CITY. All personnel assignments for inspection shall be <br />isubject to the approval of THE CITY. Compensation for inspection personnel <br />ishall be made at hourly rates as set forth in Schedule B. <br /> <br />;It is understood that work of General Engineering Services Section III.A. and <br />ihourly work on fee basis engineering projects shall be subject to the <br />ilimitations of a predetermined budget which shall be provided by THE <br />iENGINEER prior to proceeding on a work item. <br /> <br />ilt is understood that work ofa basic nature as that supplied on improvement <br />projects (Section ll.B.) shall be salary cost times multiplier plus direct <br />~xpenses and shall be subject to a maximum amount as negotiated with THE <br />iC ITY. <br /> <br /> It is understood that work accomplished of a basic nature on projects funded <br /> Wholly, or in part, with state or federal grant or loan monies shall be <br /> compensated in accordance with the requirements of the funding agency(les) <br /> <br /> it is understood that changing conditions may warrant a change in budget for <br /> any engineering work which may only be made with City approval on a timely <br /> basis. Any consideration for adjustment of a budget must be brought to the <br /> ,~ttention of the City Council for approval. <br /> <br /> It is understood that all engineering projects may only be initiated by THE <br /> ITY THE ENGINEER agrees to work on a budget basis for the preliminary <br /> Study phase of engineering projects even though the project eventually may <br /> be completed on a fee basis. The preliminary study fee in this case shall be <br /> [ <br />'fully credited to the final fee. Any phase of a project may be initiated by THE <br />CITY. <br /> <br />I't is understood that special meetings with City Officials and Staff or City <br />~ouncil meetings attended in conjunction with projects shall be included in <br />~he fees for those projects. THE ENGINEER shall furnish a representative to <br />attend other City Council meetings at the request of THE CITY at a cost of <br />~45 per meeting. <br /> <br />10 <br /> <br /> <br />
