June 23, ~992 <br /> <br />ADDENDUM TO CASE #2 <br /> Chief Auspos <br /> <br /> I have been advised that Ralph's Hi 10 Liquors has still not <br />done necessary construction to remedy the problem with square <br />foot spa¢%. ~City ordinance requires 4,000 'square feet of space <br />for any off~ale liquor establishment, which space is to be for <br />retail sa~esland storage. In the case of Ralph's Hi 10 liquor <br />his recen~ expansion into the basement area for Ralph's Guns and <br />Pawn has ~ed~ced that 4,000 square feet substantially. <br /> Thislwa~ brought to my attention some time back and I talked <br />with RalP~ N~sseB about this. He agreed to put up a fenced <br />storage a~ea!to the rear of the building, attaching it to the <br />structure~ a~d use this for outside storage. He was to size it <br />so as to ~ga~n have 4,000 square feet of space. At that time, if <br />memory se~ve~ me, he said he would do this in 90 days. Because <br />of the press!of day to day activities I neglected to follow up on <br />this and it had slipped my mind. I was recently reminded that he <br />does not ~ave the required 4,000 square feet of space and has not <br />put up %½~ f~nced area. <br /> This ?e~ds to be discussed by the council before approving <br />the renewal ~lcense for Ralph's on 10. We have, in the past, . <br />attachedc~n~ingencies on not only renewals but also for new <br />licenses, i I~ the Council finds that Ralph's on 10 is in fact in <br />variance ~i~hl the ordinance it may want to consider approving the <br />renewal wiith ~a contingency attached requiring that the 4,000 <br />square fee~ be restored by whatever means reasonable and attach a <br />time perio~ f!or this to be accomplished. <br />mga I~ <br /> <br /> <br />
