CITY CODE ENTITLED "ADULT USES PRINCIPAL" <br /> By: City ~ktt0~'ney Wdllam Goodrich and Zoning Administrator Sylvia Frolik <br /> <br />Background:~ <br /> <br />By introduetioln of~an ordinance on May 26, 1992, the City Council initiated an amendment to <br />Section 9,11ilg~, Sd~bd. 3, Paragraph b of the Ramsey City Code. The purpose of the amendment <br />is to permit ,m0~re ~t~an one adult use in any adult use location existing as of December 16, 1990, <br />which is the affeeU~e date of the City Ordinance creating the Adult Use Section. The reason for the <br />amendment ia ~ rrii~imize the number of locations required to accommodate such adult uses. <br />The proposed 6rdin~nce is enclosed for your information. <br />Observations: <br /> <br />The proposed~ord~inance was subjected to a public hearing by the Planning and Zoning <br />Commission.o~.Jt?e 2, 1992. Larry Holmberg, present owner of the Adult Bookstore on Hwy. <br />#10, was present. Mr. Holmberg stated his support of the proposed ordinance. <br /> <br />Mr. Tigue, at~t0rneY~ for Larry Holmberg, was also present at the public hearing and commended <br />the City for the~:pe~iting change to the adult use section. Mr. Tigue requested that the Planning and <br />Zoning com~sio{a Consider initiating another amendment to the Adult Use section of City Code, <br />specifically that subsection pertaining to amortization of nonconforming adult uses. Mr. Tigue <br />stated the ad~t¢~se S/~condary affects that were to support amortization of non,conforming adult uses <br />are disappearihg.:fThe County Board of Equalization reversed the City s decision to reduce <br />property value~ by 25% for those properties in the vicinity of the Adult Bookstore. In addition to <br />that, Ramsey's!Poi~ce ,Chief has stated publicly that there has not been an increase in crime as a <br />result of the btokstore s existence. Based on this, Mr. Tigue suggested that the amortization of <br />nonconformi~ng ad~lt uses be repealed from City Code and that a five year amortization be <br />implementedfgr tl~se cases where an adult use is proven to be a threat to public health. <br />Recommendation: <br /> <br />The Planmng ~d ~7_~onmg Commission was not recepnve to Mr. T~gue s suggesnon to amend C~ty <br />Code to repaal, amortization of nonconforming adult uses.
