CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT - GLENGARRY <br /> <br />THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal corporation of the State of Minnesota (the "CITY"), and ROBERT AND <br />BARBARA MC DONALD, husband and wife, whose address is 14828 Evergreen Street <br />N.W., Andover, Minnesota ("the DEVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of the following described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described <br />as follows: <br /> <br />McDonald Addition, Anoka County, Minnesota, <br /> <br />the "Subject Property"; and <br /> <br /> WHEREAS, on June 2, 1992, pursuant to Resolution ~/92-06-~, the CITY approved <br />the final plat of the Subject Property which plat is known as MC DONALD ADDITION (the <br />"Plat") contingent on certain requirements, including DEVELOPER and CITY entering into this <br />contract; and <br /> <br /> WHEREAS, the Plat consists of two (2) lots totalling approximately fifty-four (54) <br />acres; <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Subd. 2) entitled "Division or Consolidation of Unplatted Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. All lots in the Plat have access onto Variolite Street N.W.. There shall <br />be a common access point the depth of the fight-of-way of Variolite Street N.W. for Lots 1 <br />and 2, Block 1. The access point shall be located where the common lot line between Lots <br />1 and 2 intersects Variolite Street N.W. and the driveway alignments through and beyond <br />the fight-of-way shall be designed accordingly. <br /> <br />Drainage and Utility Easements. Drainage and utility easements shall be dedicated to <br />the CITY as shown on the Final Plat. <br /> <br />II. <br />GENERAL <br /> <br />Park Dedication. Park dedication shall be satisifed by dedication of land for the Trott <br />Brook trail as identified in the City's Parks and Comprehensive Plan.
