The options at this point are: <br /> <br />a) <br /> <br />Deny the application for a temporary conditional use permit and order the auto repair activity <br />vacated from the property at some point in the immediate future. <br /> <br />b) <br /> <br />Approve the temporary conditional use permit for a specified time flame and impose conditions <br />of operation during that time frame. <br /> <br />In January, City Council did not discourage Mr. Dinnetz from applying for a conditional use permit to <br />have an auto repair facility at this location. Since that time, Mr. Dinnetz did put forth a good faith effort <br />and invested in a professionally drawn site plan and initiated clean up efforts. He also displayed a <br />cooperative nature by amending his application to a temporary conditional use permit when he learned of <br />City Staff concern that the proposed use did not fit the criteria of being 'generally compatible with the <br />area'. Mr. Dinnetz has also followed through with his proposed commitment to vacate the property within <br />a designated time frame b.y actively seeking an alternate location. In addition to all of this, there is some <br />major construction occumng on all four sides of the property. Use of the property for auto repair for a <br />limited period of time should not adversely impact the area at this point. <br /> <br />Recommendation: <br /> <br />Based on the above, my recommendation is to grant a temporary conditional use permit that would expire <br />in 12 months or when Mr. Dinnetz ceases to occupy the property, whichever comes first. If Council <br />follows this recommendation, then they should review the findings of fact. The one finding I would <br />recommend amending is #11 regarding traffic. In my opinion, the traffic from the proposed use would <br />have no more of an adverse impact than if the property were developed with multi-family housing, for <br />which it is currently zoned. As you will note, them are some positive and some negative findings.
