Commission{~r H~ndriksen stated there has been a long history of issues relating to this property and he wOiaid feel uncomfortable recommending the approval of this conditional use permit because of~the p~evious conditional use permit. He inquired why there was no back~ound informatiOr~ ~roVi~ed for the last CUP. Zomng Ad~.'msttator Frohk stated she did not include background information germa e to the previous CLIP be~,ause h~. Fred Dinnetz is applying for the conditional use permit, not Mr. Gerald Root. Evenithbagh Mr. Dinnetz is asking for an 18-month CUP, he wiIl be purchasing the property fr0n~ M~'i Root as an investment property. Commissioner H~ndriksen stated that the property is still under Mr. Gerald Root's ownership. Attorney Iaa~tcso~ stated that the purchase agreement has been signed by Mr. Root and Mr. Dinnetz, coningS:bt upon the conditional use permit, the zoning, etc. Ms. Frolik ~t~tcd ithat the date of the Conditional Use Permit could coincide with the sale of the property to ~. D~nnetz; therefore, ff the sale fails, there will be no conditional use pernfit granted. The CommisSion l~roceeded to review the findings of fact. Comrmss~ong D~mer stated there ~s an error m Item #6 which reads "Dmt the adjacent parcels to the west and ,~outl~ are zoned R-3 Urban Residential, the parcel to the north and the property across Nowthen B°t~lev~d to the east is zoned R-1 Urban Residential". He stated the parcel to the west ~s zoned R,I.~ Zoning Admifiistr'.ator l::rolik stated she would verify this. Motion by Cgmmiss~oner Deemer and seconded by Commissioner Terry to amend #11 to read "That the prOp, os~ use will adversely impact u'affic in the area".
