CASS <br /> <br />REQUEST FORi EXTENSION TO 90 DAY TIME FRAME FOR RESOLVING USE <br />ACTIVIT~Y ON PROPERTY LOCATED AT 14600 NOWTHEN BLVD. N.W. <br /> ' By: Zoning Administrator Sylvia Frolik <br /> <br />Background;- <br /> <br />As you may.r~all, on January 28, 1992, the City Council revoked the conditional use permit at <br />14600 Nowth~-n Blvd. N.W. for auto sales and repair based on non-compliance. A term of the <br />revocation Wa~ thal the property owner had 90 days to either successfully obtain a new conditional <br />use permit to rOom accurately address the scope of auto repair activity on the property or vacate the <br />premises of a~o r~pair activity. Consequently, the property leasee (Fred Dinnetz of ATH, Inc.), <br />with the eooperatio~n of the property owner (Gerald Root), applied for a new conditional use permit <br />for auto repaii' which was scheduled to go before City Council for consideration on April 28. <br />Council action~ on [~he request for a conditional use permit on April 28 would have resolved the <br />issue within ~t 90 day time frame. However, I relied on my memory versus my schedule when <br />submitting casi~s fa the Council agenda and unfortunately, I forgot Fred Dinnetz' case. <br /> <br />ObservationS: <br /> <br />The next availgble meetings for Council action is May 12 and May 26. Mr. Dinnetz' representative <br />cannot be present On May 12 and requested that the case be addressed on May 26. <br /> <br />I would like t0 take this opportunity to briefly update City Council on the status of Fred Dinnetz' <br />proposal. ~ojne Weeks ago, Staff met with the applicant regarding our concern for the <br />incompatibility of ~ auto repair use with all of the surrounding residential development in this <br />particular viCitaitY.' Based on concerns expressed by Staff, Fred has amended his request to a <br />temporary congifiogal use permit (18 months maximum) to allow him a sufficient amount of time <br />to find a location for his business that would be more compatible with surrounding uses and <br />financing to01~ Wirfla which tO develop the business. This request was presented to the Planning <br />,.,nd Zoning CO, remission at their meeting on April 6. The Planning and Zoning Commission has <br />reco!.'mnendeXt genial of a temporary conditional use permit. <br /> <br />Recommendation: <br /> <br />In lieu of St~' error, it is recommended that Council grant a 30 day extension to resolve use <br />activity at 14600 Nowthen Blvd. N.W. <br /> <br />Council Action: <br /> <br />Motion~to: <br />Grant/denYia thirty (30) day extension to May 29, 1992 to resolve the conditional use of <br />14600Nowthen Blvd. N.W. <br /> <br />Review Checklist: <br /> <br />CC: 4/28/92 <br /> <br />City Administrator <br />Zoning Adminisu'ator <br /> <br /> <br />
