The settlement proposes a compensation award for the easements which is <br />~f~t~he land value for the permanent easement and 10% of the land value for the <br /> <br />temporary eg~, ~me.ht. It is my understanding that this is an accepted basis for compensating <br />casements. <br /> <br />The trustee f~oi~ the[Guy property has submitted an apprmsal which values the land at $1.50 per <br />square foot, i~is'-~ppraisal was prepared for the purpose of marketing the property in Februar!, <br />1990, which!pj-¢da~tes the conception of the sewer and water project and lends to its credibilitx. <br />Our Assegs°r!l TM dat~ indicates the $1.50 per square foot appears to be somewhat high. His daia <br />suggests !~hat ~'a!0e closer to $1.00 per square foot may be more realistic, although some very <br />large pareel~s ~eh~!s the K-Mart property have sold for $1.25 per square foot. <br />The prop0se0:beg4tiation would mean a payment of $6,634.50 for the permanent easement and <br />$1,990.35 f°i';~e t~mporary easement for a total of $8,624.85. <br /> <br />I believe therd, ami two factors which favor authorization of the easements for the negotiated <br />amount. Firsl:~if t~e easements were taken to condemnation and the commission were to aaree <br />with our IoW~ v~ 'l{)ation, we would realize less than $3,000 savings. The actual savings w~uld <br />likely be less ~n~ e[the commissions have a tendency to split the difference between conflicting <br />appraisals..I.'.J![eil ~¢r event, the estimated cost of condemnation proceedings are in the range of <br />$4,000. 8eC:~t~,, fll four properties benefitting from the project will be granting easements. All <br />properties W~llbi :mrged for the cost and be credited with contributions for easements.
