CASE #5 <br /> <br /> ADOPT ORDi~NANCE ESTABLISHING REGULATIONS FOR OPEN BURNS <br /> AND AD~PT RESOLUTION ESTABLISHING FEES AND RATES FOR <br /> ~ OPEN BURN PERMITS <br /> , By: Zoning Administrator Sylvia Frolik and <br /> ~ ~ Environmental Specialist Bruce Bacon <br /> <br />Background:i <br /> <br />As vou recall, On F~bruary 25, 1992, City Council introduced the proposed ordinance to amend <br />the ~-egulationslf~or'0Pen burns. At that time, Staff was directed to make some minor amendments <br />to the ordi,nar~¢~..Those amendments have been made and the ordinance is eligible for adoption at <br />this time. The l~rop~sed ordinance is enclosed for your information. The ordinance would become <br />effective 30 d~a~s following publication. <br /> <br />Observations; <br /> <br />You will note Rat the ordinance states that the fees for the open burn permits will be set by City <br />Council resOlutiOn; iTherefore, a resolution is also enclosed for your consideration which will set <br />the rates for 01:~en I~urn permits in 1992. It is proposed that there be a $20.00 non-refundable <br />application fee. i This non-refundable fee is intended to defray the cost of City Staff time to review <br />the application ~nd:,i~spect the proposed fire site and materials. There is also a clause to require the <br />property owner~to p~y for fire suppression costs in the event the open burn gets out of control. If <br />the application:is approved, it recommended that the permit fee be volume based as follows: (This <br />fee is intended io m~over some of the costs incurred by the City in administering the burn pern~it <br />and event.) ~ <br /> <br /> Tier 1~ ~· Up to and including 5 cubic yards of material $5.00 <br /> Tier 2 i ' ~ 6- 100 cubic yards of material $2.00/yd. <br /> ',More than 100 cubic yards of material $5.00/yd. <br /> Tier 3 <br /> <br />In comparison lo th~ cost for on-site open burning, the cost to dispose of brush, stumps, etc., at <br />of the local sill~ th,at accept wood debris ranges from $24.75/ton to $56.56/ton. Chippine fees <br />range from $4.,~f0 ubi$17.00 per cubic yard. Disposal of wood debris on site by burning saves the <br />property °wne~! additional handling and hauling expenses, but trades off local air quality and <br />increases the m~sance and fire safety risk. <br /> <br />Based on pas[ f;co,rfls, 75% of the applications for open burns in Ramsey would fall into Tier 1. <br />Tier 2 would el: nsn~te 20% of the applications which are from contractors, builders, developers, <br />etc. Tier 3 w0tild ~b~e an occasional category that involves unusual circumstances and increased <br />liability or City ~taff~ ~ rime. <br />Recommenda!i°nl <br />City Staff rezOramerlds adoption of the proposed ordinance and resolution. <br /> Council .~cri0n: .
