Subsequent to this approval, Ramsey City Staff received an <br />application fo~ a p~emises permit from the Anoka Area Ice Arena and was informed that a valid <br />lease did. not ~:xiSt[ for 1992 at that location for the Cystic Fibrosis Foundation. Therefore, on <br />January I4, 1~92~h resolution applying an application for a premises permit at J.R. s Saloon and <br />Food from th{Anc~ka Area Ice Arena Association was approved. Subsequent to these approvals, <br />the Chy wa~ i~fo~ed by the Gambling control Board a, nd the Attorney General's Office, that a <br />vaIid lease fc~.tlS¢ Cystic Fibrosis Foundation at J.R. s Saloon and Food did exist in that a <br />premises Pem~.~ t ha~ previously been issued for this organization at that location. <br />Further, unde~Rar~sey Municipal Ordinance #7.61.04, Paragraph C, gambling locations shall be <br />limited to or[e~liCehsed gambling organization at any one time in the licensed premises and any <br />rooms adJoirii~g th~ premises under the same management. This paragraph goes on to read that no <br />lease shall De ~ad;? with one organization while another lease is in effect for the same on-sale <br />establishment,i <br /> <br />In conversatlo~n w,~th Mr. John Garr~ of the Attorne5 General s Office on February 11, 1992, it <br />was outlirtedit~at ~tfappears the City has the following options at this point: <br /> <br />1. It can: ~nd.~at it is not in agreement with that provision of the ordinance which allows only <br /> one ga[rnbli[ng organization at a given premises and therefore can affect a change in the <br /> ordina~ce. <br /> <br />2. It can detet~nine that it is interested in this particular ordinance provision and therefore <br /> attemp~to e~force the ordinance. <br /> <br />3. It can let t}ae ordinance stand as is but not affect enforcement of the provisions of the <br /> ordinatice.: <br /> <br />4. It can a~oPt~a resolution rescinding approval of the premises permit application for either of <br /> the two orgt~nizations. <br /> <br /> <br />
