Goordrich stated other issues are addressed in the ordinance like
lighting and noise that have to be o~plied with even though they are not
specifically addressed in each permit; do agree that requirements for
perking and driveway areas r~_cd to be more clearly defined. Mr. Goodrich
also noted that there is a large piece of machinery on Mr. Root's property
which violates the oonditional use permit.

Mr. Boot stated that the machinery to which Mr. Goodrich referred is being
rem~wed.

Motion by Councilm~mber Cox and-seoondea by Council~ber Pearson directing
City Staff to draft a revised conditional use permit for Mr. Root.

Further Discussion: City Attorney Goodrich stated that the motion is
directing that a revised conditional use permit be drafted indicating that
traprock wLll suffice pursuant to what ordinance requires. Councilmember
Cox stated that the determination on traprock is for Mr. Root's conditional
use permit only and not conditional use permits in general. Mr. Goodrich
ass~z~ed that this motion also implies waivin~ of the escrow required at a
previous Council m~eting.

Motion carried. Voting No: None.

Council recessed at 8:55 p.m.

Mayor Raimann called the meeting back to order at 9:10 p.m.

I
It

!
I
I
I
I
I
!

Case ~5.. R~qu_ est For Metes And Bounds Subdivision: Case Of Mr. Gerald

Ms. Norris stated that Mr. Bauer is requesting a metes and bounds
subdivision between Lots 3 and 6, Block 10, Ford Brook Estates, in order to
transfer land f r~m Lot 6 to Lot 3 as much of LOt 3 is covered with wetlands
and he wants to avoid bringing in fill to make it a better buildable site.
Planning and Zoning Cc~mission recor~T~d denial of the request because it
would create two substandard lots.

[

Motion by Councilmember Cox and seconded by Councilmember Pearson to
approve a 50 foot maxim~ metes and bounds subdivision between Lots 3 and
6, Block 10, Ford Brook Estates contingent upon Mr. Gerald Bauer's pt~rchase
of these properties.

Further Discussion: Council~her COx stated that this subdivision will
only be carried through if Mr. Bauer purchases the subject properties.
Councilm~mber DeLuca stated that he reviewed the subject property and he
has o0ncerns with it's buildabiltiy, especially because of deep, deep
slopes on the property.
