Goordrich stated other issues are addressed in the ordinance like <br />lighting and noise that have to be o~plied with even though they are not <br />specifically addressed in each permit; do agree that requirements for <br />perking and driveway areas r~_cd to be more clearly defined. Mr. Goodrich <br />also noted that there is a large piece of machinery on Mr. Root's property <br />which violates the oonditional use permit. <br /> <br />Mr. Boot stated that the machinery to which Mr. Goodrich referred is being <br />rem~wed. <br /> <br />Motion by Councilm~mber Cox and-seoondea by Council~ber Pearson directing <br />City Staff to draft a revised conditional use permit for Mr. Root. <br /> <br />Further Discussion: City Attorney Goodrich stated that the motion is <br />directing that a revised conditional use permit be drafted indicating that <br />traprock wLll suffice pursuant to what ordinance requires. Councilmember <br />Cox stated that the determination on traprock is for Mr. Root's conditional <br />use permit only and not conditional use permits in general. Mr. Goodrich <br />ass~z~ed that this motion also implies waivin~ of the escrow required at a <br />previous Council m~eting. <br /> <br />Motion carried. R~qu_ est For Metes And Bounds Subdivision: Case Of Mr. Gerald <br /> <br />Ms. Norris stated that Mr. Bauer is requesting a metes and bounds <br />subdivision between Lots 3 and 6, Block 10, Ford Brook Estates, in order to <br />transfer land f r~m Lot 6 to Lot 3 as much of LOt 3 is covered with wetlands <br />and he wants to avoid bringing in fill to make it a better buildable site. <br />Planning and Zoning Cc~mission recor~T~d denial of the request because it <br />would create two substandard lots. <br /> <br />[ <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson to <br />approve a 50 foot maxim~ metes and bounds subdivision between Lots 3 and <br />6, Block 10, Ford Brook Estates contingent upon Mr. Gerald Bauer's pt~rchase <br />of these properties. <br /> <br />Further Discussion: Council~her COx stated that this subdivision will <br />only be carried through if Mr. Bauer purchases the subject properties. <br />Councilm~mber DeLuca stated that he reviewed the subject property and he <br />has o0ncerns with it's buildabiltiy, especially because of deep, deep <br />slopes on the property.
