I

I

I
I
I

DATE:

TO:

FROM:

CC:

Ramsey
;i!y of
[5'llt~NOWTHEN BOULEVARD N.W., RAMSEY, MINNESOTA 55303 ~, (612) 427-1410

MEMORANDUM

i De~ember 27, 1991
Ra4asey City Council
Zoning Administrator Sylvia Frolik

Administrator Ryan Schroeder
Ge0, rge Cowles

RE: ~:Co~vles Addition/Multiple Structures and Land Uses

i t
As you fecal[, th{e City Council granted final plat approval to Cowles Addition, a minor
subdivisiOn,O~ De{cember 17, 1991. At that time, it was noted that there are four main buildings,
each witi~ a fifffer~.nt use, on two lots and City Code limits each lot to one main building. The
discussio~n leg:l!t° tl~e direction that City Staff research to determine which structures and uses are
consideredt°ibel}ermined and which should be considered non-conforming, either lawful or
unlawful.

There is not ~nou[gh documentation in the property file to determine when each of the four
structures wCr~ constructed. So, I reviewed aerials on file at the County Surveyor's office and
determined:th~.t th4 structures for the private residence, the former Part3, House a~d C&L Canvas
Crafts were: bgilt-s0mewhere between 1966 and 1969. The structure housing the auto body shop
was cons~dt~ so~l~newhere beiween 1969 and 1973. I have not been able to determine when that
part of code that lilnits lots to one main building was adopted and to do so, would require a great
deal of time. lin he absence of supporting documentation, the City would have to make a
determination jn f: /or of the property owner. That being that all four structures were most likely
constructed 0n~the ~roperty prior to any code limiting main buildings to one per lot.

Now that:we:i .~ve ~stablished that two main buildings/uses are permitted under today's code and
four currenfi~ exist as lawful non-conforming, we have to determine which two of the
structures/uS~ shOUld be considered permitted and which two should be regulates under the non-
confomqingUs}s se[ction of the City Code.
Since as far b~ck is January, 1977, the property has been zoned Business. Based on that and
,uses are under today's Rural Business zoning, I would make a determination

what the perm[tt.e~
that the eating[~.'n,
residence: aqd,kthe
conforming.~in~l sh
ma,, not be ettyge
the{r value, unl~ss {

qng establishment and C&L Canvas Crafts are the permitted uses. The private
auto body shop are the two uses that should be considered lawful non-
told be regulated accordingly. This means that they may continue to exist but
and may not be reconstructed if they are ever destroyed to more than 50% of
lone so in conformance with City Code.
