Mr. Schroeder Page 4 December 16, 1991 Randall, Dehn & Goodrich Subject to the rights of termination described in Paragraph 8, the provisions of this letter shall be deemed to be automatically extended from year-to year or extended with such modifications or adjustments as the City and the Firm may from time-to-time mutually agree to. PROSECUTION SERVICES: The City appoints the Firm as its municipal prosecuting attorney, with Thomas M. Fitzpatrick acting as primary prosecutor. 2 o The Firm shall be responsible for rendering all legal services required in connection with the prosecution of petty misdemeanor, misdemeanor and gross misdemeanor offenses alleged to have been committed in the City. Such responsibility shall include the following: Preparation for and attendance at all arraignments (if required), hearings, pretrials, trials, sentencing and post sentence hearings involving such offenses; Preparation of formal complaints, motions, pleadings and other documents required in connection with the prosecution of such offenses; Notification and/or subpoenaing of all witnesses for court appearances or of continuances of such court appearances; Handling all necessary communications with wiunesses, police department personnel, court and judicial personnel, defendants and defense atscrneys; and Prosecution of an appeal to the Minnesota Court of Appeals on any such offense brought by any defendant on or behalf of the City.
