Goodrich, city Attorney <br />Snowmobile Ordinance Review <br />August 11, 1988 <br /> <br />I have reviewed the proposed snowmobile ordinance in conjunctioI~ <br />with your comments on this subject at the Commission's meeting <br />June 9, 1988. <br /> <br />With regard to Section llO.014A.E., I thought it was t~e <br />Commission's intention to follow State law regarding when and <br />where trunk highways, county state aid roads or county highway <br />can be used by snowmobiles. Because this is a fairly lengthy <br />provision, I did not include the specific language. I am <br />attaching a copy of the relevant statute which is MSA 84.87, <br />which specifically states the .regulations relating to these <br />highways. <br /> <br />With regard to Section ll0.014A.F., to be consistent with. <br />84.87, snowmobiles would be permitted to operate on trunk, county <br />state aid or county highways, unrestricted as to hours of <br />operation. The City does, however, have the right to restrict <br />hours of operation if it cho~s even on these streets <br />by statute. <br /> <br />With regard to Section 110.014B.1, MSA Section 84.87, which <br />applied to trunk, county state aid or county highways, provides <br />that all provisions of the state speed laws apply, together w~t~ <br />the provision that no snowmobile may be operated at a rate of <br />speed greater than reasonable or proper under all surrounding <br />circumstances. <br /> <br />Finally, MSA 84.87, Subd. 3 states that local units of <br />government may regulate snowmobile operations if said <br />"regulations are not inconsistent with the provisions of Section <br />84.81 to 84.88 inclusive and rules promulgated thereunder." <br />Based on this language, I do not believe the city can restrict <br />the use of snowmobiles on trunk, county state aid or country <br />highways in a manner other than as prescribed by MSA 84.87, ortner <br />than hours of operation above stated. <br /> <br />Please let me know if you would like further information or <br />ordinance revisions. <br /> <br /> I <br /> I <br /> I <br /> <br />! <br />'1 <br /> <br /> I <br /> I <br /> I <br /> <br /> I <br /> ! <br /> I <br /> ! <br /> I <br /> I <br /> I <br /> I <br /> <br /> <br />
