If the alternative course of action is taken, the City would have to rezone the Rural Business <br />properties to B-1. There should be no opposition to the rezonings since they are basically a district <br />name change and there would not be a loss of permitted uses. Currently, there are no parcels <br />zoned Rural Industrial that would require rezoning to Industrial. <br /> <br />The Planning and Zoning Commission agreed that merging Industrial and Rural Industrial and B-1 <br />Business and Rural Business is a better alternative to achieving the necessary adjustments to the <br />zoning map and City Code. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />c) <br /> <br />d) <br />e) <br /> <br />Site location maps A, B and C depicting parcels to be rezoned <br />City Code Sections B-1 Business, Rural Business, Rural Industrial and Industrial <br />Letters from Mark Manderfeld dated 11/26/91 and Richard Hauser dated 12/3/91. <br />Public hearing and Planning and Zoning Commission meeting minutes dated <br />December 3, I991. <br />Planning and Zoning Findings of Fact dated 1/'7/92 <br />Proposed Ordinance <br /> <br />Recommendation: <br /> <br />City Staff and the Planning and Zoning Commission recommend adopting findings of fact and <br />denying the rezoning of properties outside the urban area to Rural Business and Rural Industrial. <br />However, Staff is not in agreement with the Planning and Zoning Commission findings of fact as <br />proposed. Staff is recommending that Findings 8 through 12 be replaced with the following: <br /> <br />That there was a general feeling of apprehension expressed by some of the affected <br />property owners at the December 3, 1991 public hearing, that the proposed zoning <br />amendment would constitute a downzoning and adversely impact property values. <br /> <br />That there is testimony on record that the proposed zoning amendment will not <br />adversely impair the market value of the subject properties, with the exception of <br />those unplatted, undeveloped B-1 Business parcels proposed to be rezoned to Rural <br />Business. <br /> <br />That the proposed zoning amendment will be harmonious with the objectives of the <br />Comprehensive Plan. <br /> <br />11. <br /> <br />That the proposed zoning amendment will not change the essential character of the <br />area. <br /> <br />I2. <br /> <br />That on January 7, 1992, City Staff informed the Planning and Zoning <br />Commission that there is the potential for a better alternative than the proposed <br />zoning amendment that would achieve the same end result. <br /> <br />I3. <br /> <br />That the alternative method introduced by City Staff on January 7, 1992 would <br />provide the City with the flexibility to deal with the concerns of the affected <br />property owners. <br /> <br />14. <br /> <br />That delaying action on the proposed zoning amendment at this time will not <br />adversely impact the subject properties. <br /> <br />15. <br /> <br />That the proposed zoning amendment will not adversely impair the use of the <br />subject properties, but has the potential to impair their future use. <br /> <br />I <br />I <br />I <br />i <br />I <br />! <br />I <br />! <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I: <br /> <br /> <br />
