Case #1: : R~ques! for a va~ia:nce from corner side yard setback requirements; ~ case of Thomas King. Sylvia Frolikistat~d that Mr. King resides at 5915 - 177th Avenue N.W. Mr. King's home was constructed i0 19~55 and at that time, he did not anticipate that his home would be a corner lot. Subsequentl~ the!lot was developed without t~ing into consideration that at some point in time there would i~ a B5 foot setback on the south property line. Mr. King is requesting a variance from that setl~ ck ~n order to place a small accessory structure m the wcm~ty of h~s current garage and drivewayl M~. Frolik noted that it would not be feasible for Mr. King to expand his attached garage into th~ frc[nt yard as it would then encroach on the thoroughfare setback. Ms. Frolik also noted that 17~th ~venue just recently became an officially dedicated public street with the platting of Echo Rit;i~ ini1991; 177th Avenue is now constructed in its correct alignment to Class V standards. Tt~ B~ard of Adjustment proceeded to review the proposed Findings of Fact. Motion by Bo~dr0ember Deemer and seconded by Boardmember Bawden to amend Item #6 of' the proposed Fm~ng~ of Fact to red,cate that the pnnc~pal structure and attached garage on the property origihall~ fronted on St Francis Boulevard Motion carrie~l. VOting Yes: Chairman Hendriksen, Boardmembers LaDue, Bawden, Deemer and Thomd. Voting I~0: None. Absent: Boardmembers Zimmerman and Terry. Motion by BO~rdn~ember Deemer and seconded by Boardmember Bawden to amend Item #11 of the proposed }::in~ings of Fact to indicate that the applicant is prohibited from constructing the accessory stru~turO in the north yard only because of drainfield, septic and well locations. Motion carried. VOting Yes: Chairman Hendriksen, Boardmembers LaDue, Bawden, Deemer and Thorud. Voting N~: None. Absent: Boardmembers Zimmer'man and Terry. Motion by Bo~rdrfiember Deemer and seconded by Boardmember Thorud to amend kem #18 of the proposed ~indmgs of Fact to red,cate that the variance will not increase congestion of pubhc streets.
