RE U
REQUIREh

IEN'rFS

Backgroundi

CASE #1:

FOR A VARIANCE FROM THE FRONT YARD SETBACK
ON LOT 7, BLOCK 3 AND LOT 6, BLOCK 4, WINDEMERE
WOODS; CASE OF ALLEN KOENIG
By: Zoning Administrator Sylvia Frolik

Mr. Allen Kc~nig is requesting a variance from the thirty-five (35) foot front yard setback
requirements ~n Li)t 7, Block 3, and Lot 6, Block 4, Windemere Woods. The two lots front on
the dedicat¢~,._cu]l-de-sac right-of-way on Magnesium Street. N.W. However, with the
development~ d~' W!ndemere Woods, the cul-de-sac will not be paved as such but rather as a straight
through Stree~intc~ Windemere Woods. Although Magnesium will be improved as a straight
through streat, IL~t~ 7 and 6 are obligated to front yard setbacks measured from the cul-de-sac right-
of-way line. ~he.¥esult of this is that the homes built on these would have to be set back an
additional 15 t~ 25 ifeet from the road than the homes on the adjacent lots. Aesthetically, this is not
a desirable d&eld~pment plan on the smaller, urban residential lots where inconsistencies in
building setba4ks ate much more noticeable than in the rural district.
The following ~tems are enclosed for your information:

a) ~!Sitedocation map of Windemere Woods
b) I, Vtegv of subject parcels as approved m the final plat of Windemere Woods
c) ~Site'plan for Lot 7, Block 3
d) iSltCplan for Lot 6, Block 4
e) }ProIbosed findings of fact
f) iPro[ tosed variance

ObservationS:
The property ~hiel' constitutes the Magnesium Street cul-de-sac is torrens and was dedicated many
years ago.
