Commissioner introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #92-07- <br />A RES~LU'~'ION ADOPTING FINDINGS. OF FACT # RELATING TO A <br />REQUE$~ F~_R A VARIANCE TO CONSTRUCT ACCE-'~ORY STRUCTURES <br />NEARER ~HEiFRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br />ON TH~ P[IROPERTY GENERALLY KNOWN 8301 163RD AVENUE N.W. <br /> <br />1. That Mr. Daniel Brehm, hereinafter referred to as "Applicant", has properly applied for a <br /> Boar~ of ~djustment variance from Section 9.11.02 of the Ramsey City Code to construct <br /> an aCCessOry garage and a storage building nearer the front property line than the principal <br /> struc~re Bn the property generally known as 8301 163rd Avenue N.W. and legally <br /> desedbed i~s follows: <br /> Lo~t 6, Block 4, Oakridge Estates, Anoka Count3,, Minnesota <br /> <br />2. That l~e/~pplicant appeared before the Board of Adjustment for a public hearing pursuant <br /> to Seclioni9.03.05 of the Ramsey City Code on July 23, 1992 and that said public hearing <br /> was P ~ope~ly advertised and that the minutes of said public' hearing are hereby incorporated <br /> as a p rt of these findings by reference. <br /> <br />3. That t~e s~bject property is zoned R-1 Rural Residential and is approximately 2.5 acres in <br /> size;[ <br /> That ~er st~bject property is surrounded by R-1 Rural Residential zoning. <br /> That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br /> acces~ry Structures nearer the front property line than the principal structure. <br /> That t~e p~ncipaI structure on the subject property is located approximately 250 feet from <br /> the fr ,6nt p~operty.,, line. <br /> That ~e ~pplicant is proposing to construct an accessory garage approximately 100 feet <br /> from the f~ont property line and a mini-storage building approximately 190 feet from the <br /> front ~t~op~rty line. <br />8. That t tere~re unique circumstances applying ~,o the subject property that do not generally <br /> apply o o~er properties in the district; namel5, that the developer of the lot has created a <br /> 250 fc ~t front yard setback by the placement of the home; that the side and rear yards of the <br /> subj¢c: prclperty are not acceptable locations for accessory structures due to sharp declines <br /> in tOl~ gra0hy, trees, wetlands, septic system location and wetlands. <br /> <br /> That ~e sPecial conditions causing the undue hardship do not result from the actions of the <br /> Appli{ant ~s the home was platted and constructed on the property by persons other than <br /> the Ap~ lieant. <br />10. That t~he A~pplicant has submitted a petition signed by five (5) area ,r~id,e~ts stating no <br /> object~n tp the Applicants proposal for construction of an accessor5 =ara~,e and storage <br /> building. <br /> <br />11..
