CASE #1: <br /> <br />REQUEST <br /> <br />FOR VARIANCE TO FRONT YARD SETBACK REQUIREMENTS; <br /> CASE OF JOHN PLOEGER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. John Ploeger is requesting a 13 foot variance to the 40 front yard setback requirement in order <br />to construct a dwelling on Lot 8, Block 1, Reilley Estates. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed findings of fact <br />d) Proposed variance <br /> <br />Observations: <br /> <br />The subject property is approximately one acre in size and was platted in 1976. Subsequent to the <br />platting of Reilley Estates, in 1981 the City adopted the Scenic River Ordinance which requires a <br />150 foot structure setback from the Ordinary High Water mark of the river. With a 40 foot front <br />yard and a 150 foot rear yard setback, there is not sufficient area on a one acre lot to meet both the <br />required setbacks. <br /> <br />DNR is on record as preferring that communities grant variances to local setbacks versus river <br />setbacks.
