CASE # 1 <br /> <br /> REQUEST FOR A VARIANCE FROM FRONT AND SIDE YARD SETBACK <br /> REQUIREMENTS; CASE OF EUGENE DUBOIS <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. Eugene Dubois is proposing to construct an addition to his attached garage that would <br />encroach on the 10 foot side yard setback by 7 feet and the 40 foot front yard setback by 10 feet. <br />The following items are enclosed for your information and review: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Certificate of Survey <br />Proposed site plan <br />Proposed findings of fact <br />Proposed variance <br /> <br />Observations: <br /> <br />Mr. Dubois' problem is that the dwelling unit and attached garage were sited on the lot in such a <br />manner that any expansion to the garage side of the structure is prohibitive without encroaching on <br />setbacks. As a matter of fact, the existing home and attached garage were inaccurately sited on the <br />lot at the time of their construction and consequently there is already an encroachment of the front <br />yard setback. To construct an accessory garage on the opposite side of the lot is not consistent <br />with the existing development on the lot and would create a need for a second driveway. In <br />addition, the rear yard is adjacent to a flood fringe area and is subject to flooding. <br /> <br />The total area of the ear%e and proposed expansion to the garage are within the limits established <br />in City Code. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the variance. <br /> <br />Motion to: <br />Adopt Resolution ~x)2-09- adopting Findings of Fact #__ relating to Mr. Dubois' <br />request for a variance to front and side yard setback requirements on Lot 2, Block 4, <br />Greenland Hills. <br /> <br />-and- <br /> <br />Motion to: <br />Deny the request for the variance on Lot 2, Block 4, Greenland I--Iills based on the findings <br />of fact. <br /> <br />-or- <br /> <br />Motion to: <br />Adopt Resolution 892-09-. . approving the request for a variance, based on the findings <br />of fact, to front and side yard setback requirements on Lot 2, Block 4, Greenland Hills. <br /> <br />Review Checklist: Zoning Administrator <br />BoA: 9/24/92 <br /> <br /> <br />
