Commission~ <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #92-09- <br /> <br /> A RESO!3u'~,ION ADOPTING FINDINGS OF FACT # RELATING TO A <br /> REQU~,STIFOR A VARIANCE TO CONSTRUCT AN ADDITION TO THE <br /> ATTACHl~D GARAGE THAT WILL ENCROACH ON FRONT AND SIDE YARD <br /> ~ i SETBACKS <br /> <br />1. That Mr. l~ugene Dubois, hereinafter referred to as "Applicant", has properly applied for a <br /> Board; of ~djustment Variance from Section 9.20.11 of the City Code regarding the front <br /> and r~ar y~d setback requirement. <br /> <br />2. That t~e A~pplicant appeared before the Board of Adjustment for a public hearing pursuant <br /> to Se~/tion19.03.04 of the Ramsey City Code on September 24, 1992 and that said public <br /> hearing Was properly advertised and the minutes of said public hearing are hereby <br /> inco~ora~ed as a part of these findings by reference. <br /> <br />3. That ~e s~bject property is generally known as 15030 Willemite Street N.W. and is legally <br /> described hs follows: <br /> l~,t 2, Block 4, Greenland Hills, Anoka County, Minnesota. <br /> <br />4. That ~heilsubject property is located in the R-1 Rural Residential District and is <br /> approkimOtely one acre in size. <br /> <br />5. That ~ection 9.20.11 of the Ramsey City Code requires a front yard setback of forty (40) <br /> feeta,fld a ~ide yard setback of ten (10) feet in the R-1 Rural Residential Diswict. <br />6. That !he &pplicant is proposing to construct a 768 square foot addition to the attached <br /> garag~ tha~t will encroach the front yard setback by approximately ten (10) feet and the side <br /> yard J~etbabk by approximately seven (7) feet. <br /> <br />7. That ~ereJ, are umque czrcumstances applying to the Apphcant s property, namely, that the <br /> ex~sntig pDnmpal structure and attached garage were so ~naccurately s~ted on the lot at the <br /> time rJf cOhstruction that they encroached the front yard setback and virtually prohibited any <br /> futuro, ex~ansmn on the garage s~de of the property. In addmon, the subject property ~s <br /> adjacent tO.' a designated flood fringe area and it is not unusal for the rear yard to experience <br /> fioo ng, i <br /> That ~he Applicant is requesting a ten (10) foot variance from the for~y (40) foot front <br />8. <br /> yard <br /> setbaik a~,~d a seven (7) foot variance from the ten (]0) foot side yard requirement. <br />9. That ~he t4)tal square footage of the exsiting garage and the proposed garage is within the <br /> limitslestablished by City Code. <br /> <br /> 10. That ~e a~ljacent dwelling unit is located approximately twenty (20) feet from the common <br /> propeJ~'y l'me for which a variance from the setback is proposed. <br /> <br />11. That the Applicant has stated that the variance is necessary for the preservation of a <br /> subSt4ntia~ property right, namely, the right to expand garage space in a way that will be <br /> eonsi~tentiwith exisiting lot development. <br /> <br /> <br />
