section 8.04.01. sixty Day Waitinq Period. A period of <br /> s.~xty days shall elapse after the conclusion of the <br /> p~blic hearing required by law to precede the ordering <br /> of the construction of a local improvement project (the <br /> "~blic Hearing") before the actual ordering of the local <br /> improvement by the council and the council entering into <br /> a icontract for the local improvement construction. <br /> <br /> S~ction 8.04.02. Petition Aqainst the Local ImDrovement. <br /> If~ the proposed local improvement was initiated by <br /> p~tition of the owners of the real property abutting on <br /> th~ streets named in the petition, and if, within thirty <br /> da~s of the conclusion of the Public Hearing, a petition <br />~ against such local improvement is filed with the City <br /> Administrator and which petition is signed by a per- <br />i ce~tage of the owners of the real property abutting on <br />~the streets named in the initiating petition as the <br />' lo~ation of the improvement which percentage is greater <br />~than the percentage of owners who signed the initiating <br />ipe~ltlon, the council shall not make such local improve- <br />ime~t at the expense of the said abutting property owners. <br /> <br />ISection 8.04.03. Counter Petition in Favor of the <br />!Improvement. If within thirty days of the filing with <br />~h~ city Administrator of a petition against the local <br />~im~rovement as described in Section 8.04.02 above, there <br />iiS~filed with the City Administrator a petition in favor <br />iof the local improvement, signed by the owners of the <br />ire%l property abutting on the streets named in the <br />!~$tiating petition as the location of the improvement, <br />lls~a percentage greater than the percent of owners who <br />isi~ned the petition against the local improvement, then <br />!in~ such event the council may disregard the petition <br />~ag~inst the local improvement and proceed with the local <br />timprovement. <br /> <br /> iSection 8.04.04. Petition Aqainst Council Initiated <br /> '.ImProvement. If the local improvement was initiated by <br /> COdncil resolution without an initiating petition, and <br /> twi~hin sixty days of the conclusion of the Public <br /> iHearlng, a petition is filed with the City Administrator <br /> ~against such local improvement and which petition is <br /> iSi~ned by greater than 50% of the owners of all the real <br /> iprOperty parcels proposed to be assessed for and <br /> !benefitted by the local improvement, the Council shall <br /> ino~ make such local improvement at the expense of the <br /> ~e~efitted property owners. <br /> ~eCtion 8.04.05. Withdrawal of Name From Petition. Any <br /> e~son whose name appears on a petition to the Council <br /> n'~avor of a local improvement, or on a petition to the <br /> Council filed against a local improvement, may withdraw <br /> his~her name by a statement in writing filed with the <br /> ~ity Administrator before such petition is presented to <br /> thelCouncil or in person at a City Council meeting before <br /> thel City Council accepts said petition. <br /> <br /> <br />
