Apendix A CHAPTER 8 P LIC IMPROVEMENTS AND SPECIAL ASSESSMENTS Section &li P~wer to 1M~ke Improvements ~nd Levy Assessments. The city may make anyltyT~e of public improvement not forbidden by law and levy special assessments t~ pay all or part of the cost of such improvements as are of a local character.~Th~ total assessments for any local improvement may not exceed the cost of iml~ro,V.~ment, including all costs and expenses connected therewith, with interest. Nb adsessment shall exceed the benefits to the property. Section 8.2~ Effective Charter Provisions. Local improvements (the term "local improvemeht" Ishall mean a public improvement financed partly or wholly from spemal' aas~SSme~ nts) shall be carried out exclumvely .... under the prowmons of th~s charter. Section 8,3! Lqcal Improvement Orc]irmnces and Regulations. Within 90 days after .this ~hat, ter goes into effect, the council shall enact suitable ordinance(s) governing ioca~ improvements and special assessments. The ordinance(s) shall provide a ~. mI~lete working code covering the determination of assessments and assessmen~didtncts, pubhc heanngs, appeals from a collectmn of assessments, penalties f~r d~linquency in malting payments, financing of said assessments, and the certifyihg' )f unpaid assessments for collection by the proper county officer. Said ordim~nc (s) shall also provide for installment payments and notices to be given ther~°f appellate procedure, re-assessment, if necessary, and all other matters ap~rotiriate to the subject of local improvements and assessments. After the adopt~oh O~ such ordinance(s) providing for local improvements, all procedures in compliante therewith shall conform to the regulations as set forth in such ordinance(s! arid as otherwise contained in this charter. Section 8.4 i: De finifions. a.)! Abutting Property Owners This phrase refers to the owners of real property in the City of Ramsey, which parcels abut upon a proposed local improvement and benefit from the improvement. b.)! Non-Abutting Property Owners This phrase refers to the owners of any real property in the City of t~msey which does not abut, , but which may receive a benefit from a specific local improvement. i c.) Property Owner Refers collectively to the individual, indixdduals, ~ entity or entities noted as the fee owner, or in the case of land being purchased under contract for deed, to the vendee thereof, according to the then current records of the Anoka County Auditor, of each parcel of land which is recognized as a separate tax parcel by the Anoka County Auditor. d.) Benefit- Refers to an actual increase in the fair market value of a parcel of realty as the result of a local improvement. Phnted 12/2~/90 Page 17
