Apendix A <br /> <br /> benefitted property owners proposed to be assessed for such <br /> improvement at least eq,,-1 to the n;,mber of those who petitioned <br /> for the improvement, the council shall not make such <br /> improvement at the expense of the property benefitted, unless, in <br /> the meantime, there be filed with the council a petition asking <br /> that the improvement be made,, signed by benefitted property <br /> owners proposed to be assessed for such improvement at least <br /> equal in number to those who signed the petition against the <br /> improvement; in such event the council may disregard the <br /> petition against the improvement. Any person whose name <br /> appears on a petition to the council for a local improvement, or on <br /> a petition to the council against a local improvement, may <br /> withdraw his/her name by a statement in writing filed with the <br /> council 'before such petition is presented to the council or in <br /> person at a public hearing. <br /> ~8,1~.2 Regardless of the provisions in section 8.5.1, when less than <br />80 percent Of the estimated cost to the city of a proposed local improvement is to be <br />paid for byisp~cial assessment, excluding minor ordinary expenses incurred in the <br />course of city ~ffairs'vathm the szxty day period after a public hearing has been <br />held on the prO, posed improvement, a petition may be filed with the council, signed <br />by a numb, ~r of voters greater than 50% of the n-tuber of registered voters at the <br />time of the [as~ city wide election, protesting against either the improvement, or the <br />financing z ~etl~od, or both. In this event, the council shall not proceed with the <br />improvem, nt '.as proposed. <br /> <br /> 8.$.3 The city council shall follow the uniform contracting law for <br />advertising[ an~ receiving bids. In the event the lowest responsible bid exceeds the <br />cost estim~.te as provided for in section 8.5.1 by more than 10%, then no contract <br />shall be 1~, .mud in order to implement the proposed improvement, it shall be <br />necessary ~ institute the proceedings for such improvements DE NOVO. <br /> i 8;6.4 When a proposed improvement is disallowed under the <br />foregoing ~ctipns, the council shall not vote on the same improvement within a <br />period of o~e year after the public hearing on said improvement. <br />Section &6 1 A~sessments for Services. The council may provide by ordinance that <br />the cost of ~,ity [services to streets, sidewalks, or other public or private property may <br />be assessed against property benefitted and may be collected in the same ,,manner <br />as special!: ,aSSessments.
