TO:

CC:

FM:

RE:

DT:

Ryan ~_chroeder, City Administrator
Michael' Hadtrath, Insurance Agent of Record
i :
Kay, MCAloney, Personnel Coordinator ~
Liability Insurance for Park Volunteers
Sel~ternber 24, 1992

MEMORANDUM
Parks/Utilities Coordinator ~

This is in tesp0nse to the staff direction of the Park and Recreation Commission dated
September.q 0i 1992 regarding liability insurance for volunteers.
[ ;~

The City of R~msey has their 'Comprehensive Municipal Liability Coverage' through The
League of[M~.~iinesota Cities Insurance Trust (LMCIT) and has in its standard policy
coverage fCr '!a volunteer person or organization while acting on behalf of the "city" under
Section !,I, i2, 1~5). What this means is that the person or organization is not covered under
Workers (~ornpensation, however, they are covered under the General Liability section.
To illustrate the City's and the volunteer's coverage, use the following example: A
volunteer Was!planting a tree (at the direction of the Park & Recreation Commission) in one
of our citylp~s and dug the hole too deep cutting a power line and then the volunteer fell
into the hole SPraining his or her foot. The volunteer would be responsible for their paying
for their bills ~l¢e to the injury, while the cut power line repairs would be covered under the
City's liab~it~ insurance. As long as the volunteer was working under the direction of the
Park & Regreation Commission, the volunteer would not be responsible for the payment of
repamng t,he cut power hne.

I have confirmed this information with Michael Hadtrath, City of Ramsey Insurance Agent
of Record~}an~ ihe is in total agreement that it would not be in the interest of the City of
Ramsey t°i.w~Ve liability. Please feel free to contact me if there is anything else you need.
