Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #92-06- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FROM JAMES STRUWVE TO CONSTRUCT'S'METAL ACCESSORY <br />STRUCTURE ON A PARCEL LESS THAN 2.5 ACRES IN SIZE <br /> <br />That James Struwve, hereinafter referred to as "Applicant", has properly applied for a <br />conditional use permit to construct a metal accessory structure on less than 2.5 acres. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 of the Ramsey City Code on June 2, 1992, and that <br />the public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />That the subject property is generally known as 15328 Hematite Street N.W. and is legally <br />described as follows: <br /> <br />The south quarter of the west half of the Southeast Quarter of the Northwest Quarter of <br />Section 22, Township 32, Range 25, Anoka County, Minnesota. Except the east 33.00 <br />feet thereof for road and except the south 33.00 feet thereof for road and except that part of <br />said parcel which lies west of the northeasterly right-of-way of 153rd Avenue N.W. <br /> <br />4. That the subject property is zoned R-1 Rural Residential. <br /> <br />5. That the surrounding properties are zoned R-1 Rural Residential. <br /> <br />That Section 9.22.01, subd. 12.c, states that on parcels greater than one acre but less than <br />2.5 acres, accessory structures shall be built with the same type construction materials and <br />shall have the same general design and exterior facing finish as that of the principal <br />structure located on the parcel. <br /> <br />7. That the subject property is approximately 2.2 acres in size. <br /> <br />That the Applicant is proposing to construct a 960 square foot metal accessory smacture on <br />the subject parcel. <br /> <br />That the proposed size of the accessory structure is in accordance with size limits <br />established in Section 9.22.11 of the City Code. <br /> <br />10. <br /> <br />That the metal exterior facing finish proposed for the accessory structure is not in <br />accordance w/th Section 9.22.11 of the City Code. <br /> <br />11. <br /> <br />That except for a plat of one acre lots south of the subject parcel, across 153rd Avenue <br />N.W., the subject parcel is surrounded by parcels which range in size from 2.5 acres to 10 <br />acres. <br /> <br />t2. <br /> <br />That the subject parcel measured approximately 5.0 acres in size prior to the construction of <br />153rd Avenue N.W., which split the subject property into two parcels. <br /> <br />13. <br /> <br />That the lots surrounding the subject parcel were not split by the construction of t53rd <br />Avenue N.W. and retain the eligibility to construct metal accessory structures. <br /> <br /> <br />
