(DAP) does not constitute <br />a '.solldlw~te management facility." The definition of such <br />a faci!~y Iin Section 9.14.03 of the Ramsey City Ordinances <br />reads as~ <br /> <br /> " .... .~ .!facility for the storage, collection, <br /> proCesSing or reuse, conversion or disposal of solid <br /> <br />DAP dO~d~llect, store, process and convert material, but <br />none o~ ~h~ material constitutes "solid waste." <br />The ter~ '~Solid waste" is also defined in Section 9.14.03. <br />No ma~e~i~ that is accepted by DAP is "garbage" or <br />"re~us"~i? iiii This material has significant value. The <br />materia!~ ~eceived by DAP is also not "discarded waste <br />mate~&~.~i The material received by DAP~ has been <br />system~t~G~ly collected by its previous owners, who are <br />very awa~e!ibf its value. It has not been discarded. <br /> <br />The ma~e ~ls never enter the waste stream, so, therefore, <br />never n.; e~l to be separated from the waste stream. The <br />materi~i~iare collected either as a byproduct of .a <br />manufa6tlr~h~ process or after the useful life of the <br />produc~!'h~ ended. The material itself has always been <br />valuabi~. ~d useful, whether it is just now being mined <br /> ~om the earth or whether it has been used as an <br />directly <br />earlier ~r~Suct. No matter what form the metal is currently <br />· n, ~t ~s -!~aw material for manufacturing. DAP simply puts <br />that ma~e~al in a form that is more acceptable to <br />manufa~r~s ~ <br /> <br />The materials ship[:ed out of DAP ca~.not be solid waste <br />because 1~; of ~t, ~nclud~ng the furnace ~ross~ consists of <br />various ~o~modities. These commodities have continuous and <br />varied ~et value. Most are traded publicly on various <br />exohange~. <br /> <br /> <br />
