Councilmember ~ introduced the following resolution and moved for its adoption: RESOLUTION ~2-09- A RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT ~ ~' FOR AN OUTSIDE DISPLAY AREA ASSOCIATED WITH A MOTOR VEHICLE SALES LOT WHEREAS, the Ramsey City Council adopted Resolution ~)9-09- , regarding Findings of F~t for this use and herein approves a Conditional Use Permit subject to the following conditions. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMS~Y,i~NOKA COUNTY, STATE OF MINNESOTA, as follows: On i . ,1992 a conditional,,use permit ("CUP") was issued by the City of Ramsey ("City") to R~nagiKurak ("Permit Holder ) to establish an outdoor display/sales area in the B-3 Business DisRi~t:on approximately one-half acre of land generally known as 7665 Hwy. #10 N.W. and legMl~ described as follows: That l~ar~ Of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, Rang~ ZS, Anoka County, Minnesota, described as follows: Commencing at the intertron of the west line of said Northeast Quarter of the Southwest Quarter with the north~rl~ iright of way line of U.S. Highway No. 10; thence Southeasterly along said north ,~rl~ ,tight of way line a distance of 625.00 feet to the point of beginning of the land to be d~¢fibed; thence continuing Southeasterly along said northerly right of way line a distance!for 464.63 feet, more or less, to a point thereon distant 386.98 feet northwesterly of th~ i~tcrsection of said northerly right of way line with the east line of said Northeast Quar{er ~f the Southwest Quarter;, thence northeasterly at right angles to said northerly right of way ii,e a distance of 216.17 feet, more or less, to the southerly line of the Burlington NorriS. em Railroad; thence northwesterly along said southerly line of said railroad a distance of ~6.~i feet, more or less, to a point thereon distant 691.80 feet southeasterly from its inter~ec~On with said west line of said Northeast Quarter of the Southwest Quarter, thence sout§w{~terly a distance of 195.39 feet, more or less, to the point of beginning. Subject to easegaegts of record, if any. This permit/is ~s. ued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are ~ f~llows: 1. This~'permi~ 't shall remain in effect so long as the conditions imposed herein are complied wi~ eX~Pt that the permit cannot be transferred without the prior expressed approval of the Rarflse~ City Council. 2. The! subject propert, y shall be permitted for an outdoor display/sales area that will accOn~Odate a maxmmm of twenty-eight (28) vehicles. 3. The [outt~loor display area shall maintain a seventeen and one-half (17.5) foot setback from the front property line of the subject property. 4. Th~ s~bject property shall maintain a minimum of three (3) off-street customer parking spaees~!and two (2) employee parking spaces and one(l) handicap parking space. 5. The o~tdoor display area and customer/employee off-street parking spaces shall be res~c~t~ to those areas of the parcel that are hardsuffaced w/th either concrete or asphalt.
