Councilmember ~ introduced the following resolution and moved for its adoption: <br /> RESOLUTION ~2-09- <br /> A RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT <br /> ~ ~' FOR AN OUTSIDE DISPLAY AREA <br /> ASSOCIATED WITH A MOTOR VEHICLE SALES LOT <br /> WHEREAS, the Ramsey City Council adopted Resolution ~)9-09- , regarding <br />Findings of F~t for this use and herein approves a Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMS~Y,i~NOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On i . ,1992 a conditional,,use permit ("CUP") was issued by the City of Ramsey <br />("City") to R~nagiKurak ("Permit Holder ) to establish an outdoor display/sales area in the B-3 <br />Business DisRi~t:on approximately one-half acre of land generally known as 7665 Hwy. #10 <br />N.W. and legMl~ described as follows: <br /> <br /> That l~ar~ Of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, <br /> Rang~ ZS, Anoka County, Minnesota, described as follows: Commencing at the <br /> intertron of the west line of said Northeast Quarter of the Southwest Quarter with the <br /> north~rl~ iright of way line of U.S. Highway No. 10; thence Southeasterly along said <br /> north ,~rl~ ,tight of way line a distance of 625.00 feet to the point of beginning of the land to <br /> be d~¢fibed; thence continuing Southeasterly along said northerly right of way line a <br /> distance!for 464.63 feet, more or less, to a point thereon distant 386.98 feet northwesterly <br /> of th~ i~tcrsection of said northerly right of way line with the east line of said Northeast <br /> Quar{er ~f the Southwest Quarter;, thence northeasterly at right angles to said northerly right <br /> of way ii,e a distance of 216.17 feet, more or less, to the southerly line of the Burlington <br /> NorriS. em Railroad; thence northwesterly along said southerly line of said railroad a distance <br /> of ~6.~i feet, more or less, to a point thereon distant 691.80 feet southeasterly from its <br /> inter~ec~On with said west line of said Northeast Quarter of the Southwest Quarter, thence <br /> sout§w{~terly a distance of 195.39 feet, more or less, to the point of beginning. This~'permi~ 't shall remain in effect so long as the conditions imposed herein are complied <br /> wi~ eX~Pt that the permit cannot be transferred without the prior expressed approval of the <br /> Rarflse~ City Council. <br /> <br />2. The! subject propert, y shall be permitted for an outdoor display/sales area that will <br /> accOn~Odate a maxmmm of twenty-eight (28) vehicles. <br /> <br />3. The [outt~loor display area shall maintain a seventeen and one-half (17.5) foot setback from <br /> the front property line of the subject property. <br /> <br />4. Th~ s~bject property shall maintain a minimum of three (3) off-street customer parking <br /> spaees~!and two (2) employee parking spaces and one(l) handicap parking space. <br /> <br />5. The o~tdoor display area and customer/employee off-street parking spaces shall be <br /> res~c~t~ to those areas of the parcel that are hardsuffaced w/th either concrete or asphalt. <br /> <br /> <br />
