If t. he Permit Holder or its su¢~l~rs or assigns violates any material term or condition imPO~e~: by this CUP, it may be revoked and terminated ¢ons~s{ent with applicable law. Without limiting the fore~°~ng, the violation of any statute, regulation, ordinance or P%Z~!t condition imposed by lawful governmental authority and ~o~erning operations on the Site is grounds for revocation and ter~, ination of this CUP consistent with applicable law. The ichange, alteration or amendment of any such statute, reg~a~!on, ordinance or permit condition by any governmental authority other than t_he City shall not excuse the Permit Hold~rl~rom compliance with statutes, regulations ordinances or ~J~iconditions in effect on the date of the original issuance of this permit unless compliance is waived or excused by ViolatiOn a Misdemeanor. Violation of any of the provisions ofi~i~ CUP is declared to be a violation of the City of Rams~yl in accordance with Section 250.1 of the Ramsey City Codei, ~oDa~nabi!ity of CUP. Any rights conferred on Danny's Alu~n~ Processing, Inc. by this CUP are personal to the Pe~tii ~older. The City is issuing this CUP on the basis of the ~redit and reputation of the Permit Holder. The Permit Ho~d~r~~ isbell not assign or transfer this CUP without first obta~k~g approval of t_he Clty whlch may allow or disallow such!. ~ansfer in its absolute and sole discretion, in the eve~ ~ transfer, the CUP shall apply to the Permit ~olders' suo~ors and assigns. In the event the City declines for any !ir~&aon to allow the transfer of this CUP, the Permit ~ol~r.. shall either continue with aluminum processing opex;a=~ons in full compliance with the terms of this CUP or te~[~nate a!Lu~inum processing operations at its option. on-line .Inspection. The City reserves +.he right to inspect the Site for the purposes of examining and copying non- pri%ikeged records; conducting inspections, sur~eys, investi- gations, monltor~ng or sampling; and obtaining necessary inf~r~ation peri, dining to the construction, operation and envir~r~mental effect of the aluminum processing facility. InspeCtions shall be conducted during normal business hours eX¢~p~in the event of an emergency. City personnel or agents per~o_~ming ~he inspection will provide reasonable notice to the ~it ~older's personnel prior to the time of inspection. ~o~mgnts and Plans. Copies of all documents, plans, or other reports which are re_o~ired to be supplied to the F~DCA or Anoka Cou~t~ shall also be supplied concurrently to the City at no co~ :0 the City. 8
