Councilrnember <br />its adoption: <br /> <br />introduced the following resolution and moved for <br /> <br /> RESOLUTION #92-09- <br /> A RESOLUTION APPROVING THE ISSUAIq'C~ OF AN AMENDED <br />CONDITIONAL USE PERMIT TO DANNY'S ALUMINUM PROCESSING, <br />INC.BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF <br /> CONDITIONAL ~ PERMIT <br /> (Draft Date 8/27/92) <br /> <br />On ,1992, an amended conditional use permit ("CUP") was issued by the City <br />of Ramsey ("City") to Danny's Aluminum Processing, Inc. ("Permit Holder") to operate an <br />aluminum processing facility that includes the disassembly of engines and transrrdssions and <br />collection services for other non-hazardous metals and batteries on the property generally known as <br />14050 Basalt Stree N.W. and legally described as follows: <br /> <br />Lot s 1, 2, 3 and 4, Block 4, Gateway North Industrial Park Plat #2, Anoka County, <br />Minnesota; <br /> <br />hereinafter "site". <br /> <br />This permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this <br />permit are as follows: <br /> <br />Term. This permit shall remain in effect so long as the conditions imposed herein are <br />complied with. <br /> <br />Noise. Noises emanating from the site and operations shaI1 be in compliance with and <br />regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules <br />7010.0010 to 7010.0080, as amended except as modified herein by City performance <br />requirements. <br /> <br />Dust/Ash/Particulates. The emission of dust, ash or other particulate matter shall be in <br />compliance with and regulated by the State of Minnesota Pollution Control Standards, <br />Minnesota Rules 7005.0010 to 7005.0080, 7005.2770 subp. 2.A and 40 CFR Part 50, as <br />amended except as modified herein by City performance requirements. <br /> <br />Odor. The emission of odor from the operation shall be in compliance with and regulated <br />by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as <br />amended except as mod/fled herein by City performance requirements. <br /> <br />Smoke. The emission of smoke from the operation shall be in compliance with and <br />regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules <br />7005.0480 subp. 1.B., as amended except as modified herein by City performance <br />requirements. <br /> <br />Furnace Emissions and Monitoring. Emissions from the melt furnace shall comply <br />with State and Federal regulations as they exist and may be modified from time to time <br />during the period of this CUP. An independent testing laboratory shall conduct emissions <br />monitoring at least once per year or on a more frequent basis if pollutants are in excess of <br />standards. The Permit Holder shall make a complete report available to the City within <br />thirty (30) days of completion by the testing laboratory.
