Subdivisiota-iI esign Standards <br /> <br /> ~ul~d. 3. Industrial/commercial parkland dedication. <br />Subdividers of cdrgmercial/industrial land, including commercial/industrial portions of <br />Planned Unit DeVelopments, shall be required at the time the final plat is approved to <br />dedicate to th~City for park, playground, and public open space purposes, an amount of <br />land up to 5% ~f ~ gross land area as determined by the City Council. <br /> [Surd. 4. Planned unit development (PUD's). Parkland <br />dedication rcq.~ir~ments for PUD's shall provide a minimum of ten percent (10%) for <br />public open sp[aee,[a~nd recreational uses or cash in lieu of land in addition to those special <br />requirements lO {}9,20.31. <br /> <br /> Su:!~d. 5. Standards for accepting dedication of land for public <br /> <br />park pu rpos~s.~i· <br /> <br /> Land proposed to be dedicated for public purposes shall meet t h e <br /> !Oentified needs of the City. <br /> <br /> Prior to dedication for public purpose, the subdivider shall deliver to <br /> the City Attorney, an abstract of title or registered property abstract for <br /> such dedication. Such title shall vest in the City good and marketable <br /> title, free and clear of any mortgages, liens, encumbrances, <br /> assessments and taxes. The conveyance documents shall be in such <br /> form acceptable to the City Council. <br /> <br /> c. The required dedication shall be made at time of final plat approval. <br /> <br /> The removal of trees, topsoil, storage of construction equipment, <br /> burying of construction debris, or stockpiling of surplus soils is <br /> strictly forbidden without the written approval of the City Council. <br /> <br /> e. Grading and utility plans, which may affect or impact the proposed <br /> park dedication, shall be reviewed and approved by the Parks and <br /> Recreation Commission prior to dedication, or at such time as is <br /> reasonably determined. <br /> <br /> To be eligible for park dedication credit, any land to be dedicated as-as <br /> 0 requirement of this Section shall be useable, developable land for <br /> ~use for park and recreation purposes and shall be at a location <br /> convenient to the people to be served. <br /> <br /> Su.,~d. 6. Cash payment. In lieu of land dedication, the City Council <br />may require th~ salXtivider to conudbute a cash payment. The value of such payment shall <br />be either the ~eaiCr amount established by a specified contribution per dwelling unit or a <br />percent of fair th~,i~et value of the undeveloped land commensurate with the percent of land <br />which otherwise would have been required under §9.50.37 Subd. 2 and §9.50.37 Subd. 3 <br />of this chapter, i "Fair Market Value", for purposes of this subdivision, shall be determined <br />as of a t the ;time of c;T;.. <br /> ...... s a B P to v ~1 o t the final plat in accordance with the <br /> <br />following: ~ <br /> a. <br /> <br />The City Park and Recreation Commission and subdivider may agree <br />upon a recommendation to the City Council as to the fair market value <br />based upon recommendation by the ~ Assessor. <br /> <br />The City Council after reviewing the Park and Recreation <br />Commission's recommendation, may agree with the subdivider as to <br /> <br />§ 9.50.30 <br /> <br /> <br />
