Application to minor subdivisions. In the event of
a minor subdivision, the provisions of this Chapter shall apply to the new lots being created
rather than the gross area being subdivided.

Subd. 13. Application to resubdivision.

In the event of a resubdivision of a parcel for which park dedication
requirements have previously been met, no additional park dedication
requirements shall be imposed as a result of the resubdivision
providing the overall density of development of the parcel remains the
same as the density allowed under the zoning in effect at the time of
the initial subdivision.

In the event that park dedication requirements were met through the
use of a fee per dwelling unit or based on the value of the
improvement, additional park dedication shall be made for each new
lot created under resubdivision.

The park dedication fee shall be based on the specified contribution
per dwelling unit for residential properties resulting from the
resubdivision.

9.50.50 Construction of Improvements

Section 9.50.50 is hereby repealed and amended to read as follows:

Subdivision 1.
