CHAPTER 14 <br />METROPOLITAN URBAN SERVICE AREA <br /> <br />Section 14il. I Modification of the MUSA. From time to time the city may wish to <br />expand or :~o~li~y the area served by sewer and water which is commonly known as the <br />Metropotit ~an l~rban Service Area (MUSA). <br /> <br /> 14.~?1.ii Initiation. Modification of the MUSA must be initiated by a 4/5 vote of <br /> ouncil. <br /> <br /> 14.f~,2.! Evaluation of Proposed Modification. This chapter is not intended to <br /> alte~ th~ planning and evaluation process required by law. <br /> <br /> I4.1~;3. 'Ratification of Proposed Modification. Upon completion of the <br /> pla~'~ ir g~ process the proposed modification must be approved by a majority of <br /> regi[te~ xl voters prior to its implementation or submission to any outside <br /> reg~at Iry body. <br /> <br />Section 14.¢. iCommunity Development Standards. Expansion of the MUSA enables <br />residential Oe~{~lopment at a significantly higher density. The following community <br />development andards have been written to mitigate the impact high density residential <br />developmegt t.~y have on existing lower density neighborhoods thereby protecting their <br />value and' qUal !¢ of life. These standards apply to all residential development receiving <br />final plat. app': rt..val, after January 1, 1997. <br /> 14.~;I.i Residential Real Property ,,D, ensity. All resi,d,e, ntial lots platted within <br /> the ~SA after January 1, 1997, ( Subject Property ) shall provide that the <br /> numb_~, e~ pf residential platted lots per acre ("Density") of all residential lots <br /> plat..~d~ithin the Subject Property that share a common border(s) with residential <br /> lots ipl~ed prior to the Subject Property ("Existing Property") shall not exceed <br /> the iesi'er of (i) the Density of the Existing Property immediately adjoining the <br /> SUbjec~ Property at their respective common border(s) or (ii) one (1) residential <br /> ~, t <br /> plat!ediil0t for every one (1) acre of Subjec Property. And shall further provide <br /> that 'rall~residential lots platted within the Subject Property that are within 1,000 <br /> feet!off,common border(s) with Existing Property shall be subject to a graduated <br /> den~ity~ Plan approved by the city. <br /> 14.~.2.ii Traffic Generation Analysis. Residential real property platted within <br /> the M~SA. .~ after January 1, 1997, shall be subject to a traffic generation analysis <br /> whiCh 91iall be provided by the developer of the Subject Property. The City shall <br /> revi~w!xhis analysis for the purpose of making a traffic impact determination. In <br /> the !event the city's traffic impact determination establishes that the proposed <br /> dev~lo@ment of the Subject Property will significantly increase the existing traffic <br /> flo~ t~0ugh Existing Property which is destined for the county and/or Minnesota <br /> <br />,I <br /> <br />25 <br /> <br /> <br />
