CASE t4 ~-~ <br /> <br />PUBLIC HEARING AND REQUEST FOR VACATION OF DRAINAGE AND UTILITY <br />EASEMENTS FOR HIGLANDS AT RIVER PARK; <br /> CASE OF ARCON DEVELOPMENT INC. <br /> By: PatrickTrudgeon, AICP <br /> Assistant Community Development Director <br /> <br />Background: <br /> <br />The City Council recently approved the final plat of Highlands at River Park 4th Addition. As <br />part of that plat, Lot 14, Block 4 of the Highlands at River Park was resubdivided and <br />incorporated into the new plat. New easements for the lot were created as part of the 4th Addition <br />and the existing easements contained in the original lot need to be vacated. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Approved Final Plat of Highlands at River Park 4th Addition <br />Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />Observations: <br /> <br />A public hearing and ordinance adoption is required in order to vacate easements. <br /> <br />Recommendation: <br /> <br />City Staff recommends introduction of the enclosed ordinance to vacate existing easement. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #04- to vacate the easement for drainage and utility easements <br />on Lots 14, Block 4, Highlands at River Park. <br /> <br />Review Checklist: <br />Community Development Director <br />Asst.
