<br />Authority ([..I)A) ~o amquirc properties in need of redevelopment when they become available or
<br />there is at .~c,~',l i(, :ac:i [irate redevelopment. The EDA has determined that the property owned by
<br />Douglas }l~:.~:{~ {irc "Bakcstar Property") located at 14040 Azurite Street NW, is in need of
<br />rcdcvclopl~r:~l :-iN it is in a blighted condition. Recently a "For Sale by Owner" sign appeared on
<br />the Bal<t~si~ i't,.)?~.~'ty and this prompted action by the EDA. The EDA made a recommendation
<br />to atzquirc li~,- ?rt p~'rty by direct negotiations, and to use condemnation as a last resort. The
<br />i, roperty iv: i~ '1 ~: I~mrcmcnt Financing District No. 2, which is a redevelopment district. Money
<br />has bccn i')i'¢:~.'~¢}tt~;ly budgeted ibr the acquisition of properties in need of redevelopment within
<br />TIF Distric'i I'lc,. ;;. At_:quiring this property would enable the City to redevelop a property that
<br />wou Id not Ii k~;l,/~'~ develop otherwise.

<br />Administr~t~), ~,o ~%(~tiate as much as possible to acquire the property through direct negotiations
<br />with the p,'c,!)t:~-~y (,w]~e~'. Secondly~ if' that fails this resolution would authorize the City Attorney
<br />to comm¢:m:(: ,)~ eminent domain action. He explained with this type of action it is very
<br />important [~, !~:~x.'~: t~ public purpose. Recently the Supreme Court has been cautioning cities and
<br />is very co~{ (,t~(:?(t ~tboLlt acquiring private property for what is perhaps not a City purpose or
<br />pnl, lic encit::~x,)~'. '4rate statutes state that cities may acquire property for redevelopment purposes
<br />in certain tzi,',:ti~il.~;i~incc;s. In this particular situation the City has adopted TIF District #1, and
<br />also TI I~' [~i:-;t, i,. t/! ~, wl~ieh is within TIF District #1. This District #2 is defined as a renewal and
