NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF 1;L4.MSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact # , an Interim Use Permit (Permit) to allow for outside storage of commercial equipment in the front yard of a residential property is hereby granted to Jeff and Barbara Rockow, hereinafter referred to as the "Permittee". The Permit-tee is herein allowed to store a maximum of two (2) commercial trailers in an orderly manner within a con£med area in the northwest comer of the front yard.on the Subject Property. The trailers shall remain in close proximity to both the established evergreen trees as well as the five (5) recently planted evergreen trees to ensure maximum screening from other properties. See exhibit A (aerial photo). 3. The Permittee herein agrees that no stockpiling of materials, such as scrap aluminum and other debris, shall be. allowed on the Subject Property. The Permittee herein agrees that the two commercial trailers will be stored on grass and the area will be mowed and/or trimmed on a regular basis to ensure the area remains well- manicured. 5. The Permittee herein agrees that the two commercial trailers will be kept neat in appearance and will remain in a working order. 6. This Permit shall commence on the date of City Council approval of same and shall expire on March 23, 2009. This Permit is applicable only to the outdoor storage of a maximum of two (2) commercial trailers in the northwest comer of the property and the use of this area of the property for the outdoor storage of any other items is prohibited. This Permit shall become null and void in the event that outside storage of the trailers ceases for six (6) consecutive months prior to the expiration date or upon the expiration date, whichever occurs first. Both commercial trailers must be removed from the Subject Property or relocated to comply with City Code requirements within sixty (60) days of the date of termination or the expiration date of the Permit, whichever occurs first. In the event the Permittee fails to perform said timely removal or relocation, the Permit-tee herein grants the City authority to remove said items from the Subject Property at the Permittee's expense. 9. That all costs incurred by the City in administering and enforcing this Permit shall be the responsibility of the Permittee. 10. That the City Administrator or his or her designee shall have the right to inspect the Subject Property for compliance and safety purposes at any time. 30 RESOLUTION #04-03- Page 2 of 4
