Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #04-03 RESOLUTION DENYING THE ISSUANCE OF AN INTERIM USE PERMIT FOR OUTSIDE STORAGE OF COMMERCIAL EQUIPMENT IN THE FRONT YARD ON A RESIDENTIAL PROPERTY WHEREAS, Jeff and Barbara Rockow, hereinafter referred to as "Applicants", have properly applied to the City of Ramsey (the "City") for an Interim Use Permit (Permit) to allow for outside storage of commercial equipment in the front yard on the property located at 18015 Ute St NW and legally described as follows: That part of the north half Of the Northeast Quarter of Section 1, Township 32, Range 25, Anoka County, Minnesota described as follows: From a point on the east line of said north half of the Northeast Quarter said point being 12.76 chains south of the Northeast comer thereof, said point also being the centerline of public road: thence south 82 degrees, 30 minutes west on said center line of said road a distance of 1010.0 feet; thence northerly parallel with the east line of said Section 1, a distance of 451.0 feet to the actual point of beginning of the tract to be described, said last described line also being the easterty line of road easement; thence easterly parallel with the north line of said Section 1, a distance of 155.00 feet; thence northeasterly deflecting to the left 40 degees, 47 minutes 0 seconds a distance of 191.87 feet to its intersection with a line drawn parallel with and distant 700.0 feet west of the east line of said Section 1; thence northerly along said parallel line a distance of 101.75 feet to its intersection with a line drawn parallel with the north line of said Section 1, distance 227.0 feet north from the point of beginning as measured along a line ' parallel with the east line of said Section 1; thence westerly along said parallel line a distance of 301.59 feet to its intersection with said line drawn northerly and parallel with the east line of said Section 1 from the point of beginning; thence southerly along said parallel line a distance of 227.0 feet to the point of beginning. Together with an easement of access over a strip of land 30 feet in width extending from the aforementioned public road on the south and to the north line of the tract herein described on the north and the easterly line of this easement extending from a point on the centerline of the said public road which is 1010 feet from the east line of said Section 1 when measured along the said centerline, and extending north to the northwest comer of the tract herein above described. (the "Subject Property"); and WHEREAS, the Planning Commission met on March 11, 2004, conducted a public hearing and recommended that the City Council deny the request for short-term outdoor storage of commercial equipment on the Subject Property; and '.
