~n/DOT . 30780 (11176) <br /> <br /> STATE OF M!NNESOTA <br />DEPARTMENT OF TPANSPORTATION <br /> <br />TECHNICAL AND ENGINEERING ASSISTANCE AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered Into by and between the State <br /> <br /> of Minnesota acting through Its Commissioner of Transportation, hereinafter <br /> referred to as the "State", and the [;Oa..nTy <br /> herelnafter referred to as the "User", WITNESSETH: <br /> <br /> WHEREAS, the User, as evidenced by Resolution, a copy of which Is <br /> attached hereto and made a part hereof as Exhlbit A, does hereby request <br /> the State to furnish from time to time as needed and specifically requested, <br /> technical and engineering assistance pursuant to M.S. 161.39; and <br /> <br /> WHEREAS, The State is authorized to provide technlcal and engineering <br /> <br /> assistance to other road authorities by M.S. 161.39, and Is willing to do so; <br /> NOW, THEREFORE, It Is mutual ly agreed by the parties hereto that: <br /> I. The State shall, upon written request by the User, provide <br /> technical and engineering assistance and such other services as authorized <br /> by M.S. 161.39. <br /> <br /> 2.. The State shall keep a 'record of its costs and expenses, <br />Including overhead costs, in providing assistance and services to the User <br />pursuant to Paragraph I above, .and shall prepare an itemized statement thereof <br />showing the amount due hereunder and submit the same to the User on a (monthly) <br />(annual) basis. <br /> <br /> 3. The User agrees to pay to the Trunk Highway Fund of the State <br /> <br />of Minnesota all monies due hel'eu~der and as shown by the invoices or statements <br />submitted to 1he User, wlthin 30 days after such submission, <br /> <br />Page ND.
