Associate Planner Wald noted there were three letters received by Staff supporting granting of
the variance.

Dick Giddings, 18001 Ute indicated he does not see why Mr. Rockow has to build a garage. He
stated the trailers are kept very neat, and are no problem. He does not want a garage built there,
and does not know why the issue cannot be left alone. He noted if Mr. Rockow were to build the
garage on the other side of the house he would have drainage problems.

Arnie Peltzer stated he lives around the lake. He also does not think Mr. Rockow should have to
build a garage. He indicated he is only doing it because he is being asked to hide the trailers. He
thinks the City should drop the request to build a garage. He stated he planted pine trees to help
block them, and the trailers are not unsightly. He indicated Mr. Rockow is a good neighbor, and
he sees no reason for him to have to build a garage. He stated this has been caused by a couple of
neighbors with a vendetta against others in the area, and except for them this problem would not
exist.

Chairperson Nixt indicated this was an interesting situation, and asked the applicant if he were
correct in thinking that if they could find a middle ground he would prefer not to build the
garage.

Mr. Rockow indicated that was correct. He read a letter he had sent to the City on January 30,
2004 indicating the trailers have been parked in the same location for 22 years, and noting the
steps they have taken to alleviate the concern of some neighbors. He noted that twice they
thought they had the matter resolved, and both he and the mayor talked to the complaining
neighbor and thought it was resolved, but evidently the neighbor changed his mind. He stated he
has talked with Staff about putting up a garage, which would not be his first choice. He indicated
he could not put the garage on the other side of the house because of the slope, a retaining wall,
and drainage issues. He explained he has four drivers, and the trailers would have to be moved
every time anyone was going in or out of the garage. He feels he should be able to use his
property for his livelihood. He indicated he has not been able to find a middle ground. He stated
if other people can build accessory structures he does not know why he cannot, but he will go by
the Commission' s decision.

Chairperson Nixt stated to bring this in compliance the trailers would have to be stored on the
side yard. He asked what defines the side yard.

Associate Planner Wald demonstrated on the site map. She indicated the topography of the land
drops off toward the lake, and it would be very difficult to remove the trees and construct a
building in the back because of the topography.

Chairperson Nixt indicated he is trying to eliminate the necessity for building a garage.

Mr. Rockow stated if he has to park the trailers back that far he would rather build the garage, as
it would be safer and easier to get in and out.

Board of Adjustment/February 5, 2004
