Land Use Com'n, 105 Haw. 296, 97 P.3d <br />372 (2004). <br />Case Note: <br />The court also explained that in cases where the petitioner has not substantially <br />commenced use of the property, then the LUC may revert the,property without fol- <br />lowing the strictures of HRS Ss 205-4, so long as it otherwise complies with Hawai `i <br />Administrative Rules § 15-15-93. <br />Case Note: <br />DW and Bridge had also alleged that their procedural and substantive due pro- <br />cess and equal protection rights had been violated by the reversion. The circuit <br />court had agreed. The appellate court disagreed. It noted that with respect to <br />procedural due process, both Bridge and DW had notice of the OSC and that the <br />LUC might revert the property. They also each had a meaningfid opportunity to be <br />heard on the proposed reversion. With regard to substantive due process, the <br />court found that the LUC's reversion was not "clearly arbitrary and unreason- <br />able, " given the project's long history, the various representations made to the <br />LUC, and the petitioners' failure to meet deadlines.
