CASE #: I I

AMENDMENTS TO THE TOWN CENTER ZONING DISTRICT REGARDING FRONT
YARD SETBACKS AND DRIVEWWAY LENGTHS
By: Patrick Trudgeon, AICP,
Assistant Community Development Director

Background:

Staff is bringing forward amendments to the Town Center Zoning District to rectify
situations uncovered during the consideration of the first residential phase of Ramsey
Town Center being proposed by D.R. Horton. The first phase, the Ramsey Town Center
2"d Addition, contains back-to-back townhome units as well as rowhouse style townhome
units. It was determined by City Staff and the Planning Commission that the Town
Center Zoning Code does not adequately anticipate these types of units in regards to
measuring front yard setbacks and driveway lengths. In reviewing the preliminary plat of
Ramsey Town Center 2nd Addition, the Planning Commission and City Council indicated
that they were comfortable with the subdivision as shown but wanted variances or
amendments to the Town Center Zoning District to rectify the discrepancies on what was
being proposed in the development and what is contained in the Zoning Code. Staff is
bringing forward amendments to the Town Center Zoning District to better address
situations brought up as part of the Ramsey Town Center 2nd Addition plat review.

The following items are enclosed:

a) Proposed Town Center Zoning District amendments

Notification:

A public hearing on these amendments was properly notified in accordance with state
statutes and held at the March 11, 2003 Planning Commission. No public comments
were received.

Observations:

Staff is proposing language to the Town Center Zoning District to clarify how the front
yard setback is measured, to allow for a greater front yard setback for certain types of
attached residential units, and requiring 25-foot long driveways for all residential units
unless certain criteria are met.

Measurement o f front yard setback. Currently, residential units within in the Town
Center can have a maximum front yard setback of 20 feet. However, the code is silent on
how the setback is measured. Staff had some initial thought that the setback be
measured from the edge of the curb but Staff and the Planning Commission found it to be
impractical. Instead, the amendment is proposing that the front yard setback for
residential units is measured from the front of the residence to the edge of the right-of-
way
