DAI~ <br /> <br />BOARD OF COUNTY COMMISSIONERS <br /> Anoka County, Minnesota <br /> <br />11/22/83 RESOLUTION NO. 83-111 <br /> <br />OFFERED BY COMMISSIONER Cena i ko <br /> <br />RELATING TO THE ANOKA COUNTY POLICY TOWARD <br /> SPECIAL ASSES~IENTS <br /> <br /> WHEREAS, the County of Anoka owns property throughout the <br />County which is used for various public purposes; and, <br /> <br /> WHEREAS, many municipalities and other governmental entities <br />plan public improvements, anticipating that the County may.contribute <br />toward the cost of the improvement through a special assessment; <br />and, <br /> <br /> WHEREAS, a substantial amount of County property has been <br />acquired with Federal and State funds, the terms of which restrict <br />the use of the property to recreational uses and prohibit the <br />County from conveying or encumbering the property; and, <br /> <br /> WHEREAS, in many cases, because of these restrictions and <br />prohibitions, the improvements are of little or no benefit to the <br />County-owned property; and, <br /> <br /> WHEREAS, the law provides that property may only be assessed <br />.for public improve~nts to the extent that it is benefited: <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that all municipalities and <br />other governmental agencies within Anoka County are hereby requested <br />to contact the Anoka County Administration Office imediately upon <br />comencing the planning of public in~rovements for which the governmental <br />unit may anticipate assessing County-owned property. <br /> <br /> BE IT FURTHER RESOLVED that such imediate contact shall be <br />primarily for the purpose of the municipality reaching an agreement <br />with the County as to the County's benefit from the improvement and <br />as to an appropriate special assessment, if any, thereupon. <br /> <br /> BE IT FURTHER RESOLVED that said agreement between the municipality <br />and the County shall be reached prior to any project hearing on the <br />matter and prior to the municipality's estimate or determination of <br />what any of the other various entities might be or would be assessed <br />on a given improvement. <br /> <br /> <br />
