I TO: FROM: RE: Mayor and Councilmembers City Administrator Staff Report for December 1983 1) Finance - The following is hereby submitted on this item: a) Cash flow report for November 1983 and 1983 budget revenue and expenditure report for November 1983 - These reports are contained in your agenda. b) Projects denied report for 1983 - This is a rather interesting report which was done for the first time this year to keep Council informed on the costs of these denied projects. c) Transfer of funds - The transfer of funds are the normal annual transfers that are set by City policy or the budget document. Z) Seminar - The seminar that I attended on December 7, 1983 was very interesting, as it covered the litigation problems that the cities here in Minnesota are getting into in the planning, zoning and personnel area. Bill also attended this seminar and consequently; we are planning to review this seminar with Councilmembers in January or February as we have the same problems. 3) State aid lawsuit - The summary judgment was held at the Ramsey County Courthouse on November 1983. The following has been enclosed under separate cover as Exhibit ~: Mr. Rosow's legal memorandum which represents the City's case. Exhibit ~1~ represents the State's position. The State of Minnesota requested the summary of judgment, as they are trying to prove we don't have a case. Now, the attorney's for this case were directed to submit a letter to the judge. Accordingly, I have enclosed Mr. Rosow's letter that was submitted to the judge as Exhibit ~ This case will be heard in April 1984. We will be making one more try through the legislative process and hopefully we can be successful and stay out of court. We have contacted our Representative Ernie Larsen and he is setting up ~ meeting with the key tax law makers. 4) Administrative projects - We have two administrative projects still being completed in 1984 and they are as follows: a) City ordinance regarding on-site sewer systems - We will be discussing this at the meeting and should get it pretty much resolved. b) Capital improvement planning document - We still have' work to do on this. We should have it done in January. Note: There are other major projects that are still to be processed but we have been pushing to get these done before the end of the year.
