Roemer, Commissioner <br />of Revenue, <br /> <br />Defendants. <br /> <br />Court File No. 455510 <br /> <br />MEMORANDUM IN SUPPORT <br /> <br />OF DEFENDANTS' MOTION <br /> FOR SUMMARY JUDGMENT <br /> <br /> INTRODUCTIOn[ <br /> <br /> This declaratory judgment action was initiated on January <br />28, 1982 by the City of Ramsey, a municipal corPOration, and its <br />mayor, Thomms Gamec. Plaintiffs challenge the constitutionality of <br />the formula by which local government aid is distributed by the <br />State of Minnesota to its cities. Specifically, plaintiffs allege <br />that Minn. Stat. § 477A.011, et seq., violates the equal protection <br />clause of the fourteenth amendment of the United States Constitution <br />and Article 1, Section 2 of the Minnesota Constitution. Plaintiffs' <br />prayer for relief seeks declaratory and injuncqive relief only; <br />monetary damages are not sought. Defendants are the State of <br />Minnesota and the Commissioner of the Department of Revenue, <br />Arthur C. Roemer, who is statutorily responsible for implementing <br />the local government aid formula and distributing payments pursuant <br />to the formula in six installments during each fiscal year. ~nis <br />memorandum is submitted in support of defendants' motion for summary <br /> <br />j ud gment. <br /> <br /> <br />
