This is forwarded for Council information. <br /> <br />Council Action: No action is required other than to note that you have <br />reviewed the above enclosure, unless you deem other action. <br /> <br />CASE #11: OPENING OF COMPUTER BIDS ON DECEMBER 10, 1983: <br /> <br />The City of Ramsey opened bids for computer hardware and software <br />on Friday, December 1(~, 1983 at 4:00 p.m. at the Ramsey Municipal <br />Center. <br /> <br />During the bid opening process, several bids were received after 4:00 <br />and were included in the opening of the bids that were received on time. <br />One of these bids was received at approximately 4:20 and was erroneously <br />opened. These bids were to be tabulated and received by Council at <br />your January 10, 1984 Council meeting. <br /> <br />I have discussed the situation with the League of Cities' Research <br />Department and they state that this situation has arisen before recently <br />in the City of St. Paul in the opening of their bids on Cable T.V. The <br />case went to court and the City prevailed. I also spoke to Mr. Stan Peskar, <br />General Counsel for the League of Minnesota Cities, and he feels that <br />the City should adopt a motion to return all bids and go through the <br />rebidding process. <br /> <br />There is enough time to accomplish this between now and January 10, <br />1984 if Council acts on it tonight. <br /> <br />Summary: I respect both of the above views, but I would recommend <br />to Council that we do as is recommended by Mr. Peskar, the League's <br />General Counsel. <br /> <br />The question may be asked, how did this situation happen? The long <br />and short of it is, I guess, that I erred in not instructing the people who <br />were receiving the bids that day, as I was not present at the bid opening <br />due to other commitments. However, since that time, I kave closed <br />the barn door. I haven't discussed this situation with the City Attorney, <br />due to his being busy and my workload, but I think he would be of the <br />same opinion. <br /> <br /> <br />
