Rest <br />areas~ vistas and waysides shall be provided. <br /> <br />l~verfront Uses/Access <br /> <br />a) <br /> <br />Public Property. Public pedestrian access shall be provided <br />to the riverfront of all public property. <br /> <br />b) <br /> <br />Public pedestrian access shall be provided to the riverfront <br />of developments on publicly owned and publicly-controlled <br />riverfront property whether leased to private lessees or not~ <br />except where: <br /> <br />1) Unavoidable hazards exist to the public. <br /> <br />2) <br /> <br />Public pedestrian access at a particular location cannot <br />be designed or developed to provide a pleasant view or <br />recreational experience. <br /> <br />3) <br /> <br />Access to the riverfront ~ay be denied to any person who <br />creates a nuisance or So engages in illegal conduct on <br />the property and public access ~ay be temporarily or <br />permanently closed upon a finding by the City that such <br />offensive conduct cannot otherwise be reasonably <br />controlled. <br /> <br />c) <br /> <br />Public Access - Private Property. Public pedestrian access <br />shall be provided to the riverfront for all non-water <br />dependent uses which are: <br /> <br />1) Co~ercial or industrial. <br /> <br />2) <br /> <br />Developed as a planned unit development or requiring <br />subdivision approval. <br /> <br />3) <br /> <br />Access to the riverfront may be denied to any person ~ho <br />creates a nuisance or ~ho engages in illegal conduct on <br />the property and public access may be temporarily or <br />permanently closed upon a finding by the City that such <br />offensive conduct cannot othervise be reasonably <br />controlled. <br /> <br />d) <br /> <br />Rtverfront Uses. Rtverfront uses shall Ix preferred in the <br />folloving order: <br /> <br />1) Water dependent; <br /> <br />2) Non-rater dependent vith public pedestrian access; and <br /> <br />3) Non-rater dependent vithout public pedestrian access. <br /> <br /> <br />
